New points of the Ordinance on Preferential Treatment for People with Revolutionary Contributions

(Baonghean.vn) - Effective from February 15, 2022, the Ordinance on Preferential Treatment for People with Revolutionary Contributions adjusts many regulations on regimes and policies for war invalids and sick soldiers.

1. War invalids and beneficiaries of policies like war invalids have their body injury rate assessed:

-Class B disabled soldiers with a body injury rate of 21% or more are re-evaluated.

-Conditions for medical examination: Same as Decree 31/2013/ND-CP dated April 9, 2013.

The new point is to add the category of war invalids with special recurring wounds. Special wounds are: Amputation or complete paralysis of two or more limbs; complete blindness in both eyes; severe mental illness leading to loss of autonomy in daily activities.

-Examination and appraisal records and procedures: Basically the same as the regulations in Circular 05/2013/TT-BLDTBXH. However, the only difference is that the examination records must be sent by the individual to the Department of Labor, War Invalids and Social Affairs; then the Department must send them to the Ministry of Labor, War Invalids and Social Affairs for comments.

2. Health insurance:

- Additional beneficiarieshealth insuranceIncluding: Wives or husbands of martyrs who remarry. Relatives of revolutionary activists before January 1, 1945. Revolutionary activists from January 1, 1945 to the August 1945 uprising who are still alive, including: wives or husbands, children from 6 years old to under 18 years old, or from 18 years old and above if they continue to go to school or have severe disabilities or especially severe disabilities.

* Note the applicable principle: People who belong to multiple health insurance categories are entitled to health insurance benefits of the category with the highest benefit level. Health insurance beneficiaries are determined based on documents and records issued by competent authorities. In case a person with meritorious services is also a relative of a martyr, he/she will only be entitled to the highest benefit of one category.

3. Rehabilitation nursing:

- Beneficiaries and principles: Same as Joint Circular No. 13/2014/TTLT-BLDTBXH-BTC.

- New point: Nursing regime is implemented according to Decree No. 75/2021/ND-CP.

- Procedures and processes for resolving regimes: The People's Committee at the commune level, based on the health status of the subjects, makes a list of people receiving centralized nursing and home nursing according toForm No. 86 Appendix I of this Decree in the first quarter of the year, send to the Department of Labor - Invalids and Social Affairs. Then the Department of Labor - Invalids and Social Affairs sends to the Department of Labor - Invalids and Social Affairs (if eligible, the Department of Labor - Invalids and Social Affairs issues a decision to enjoy).

5. Land use fee exemption or reduction regime:

- Freeland usewithin the land allocation limit when the State allocates residential land, changes the land use purpose to residential land, recognizes the right to use residential land, when purchasing State-owned houses for the following subjects: Revolutionary activists before January 1, 1945. Heroes of the People's Armed Forces, Heroes of Labor during the resistance war. Heroic Vietnamese mothers. War invalids, sick soldiers, people infected with toxic chemicals over 81%. Relatives of martyrs receiving monthly survivor allowance.

Exemption from land use fees when purchasing a house (a multi-storey house with many households) currently rented and owned by the State according to Decree No. 61/CP dated July 5, 1994 of the Government for revolutionary activists from January 1, 1945 to the August 1945 uprising.

- Land use fee reduction: People with meritorious services specified in Points a, b, d, dd, e, g, h, i, k, l, m, Clause 1, Article 3, Ordinance on People with meritorious services to the revolution; relatives of martyrs specified in Clause 2, Article 3 of this Ordinance.

New point: This Decree has divided people infected with toxic chemicals into 4 levels like war invalids and sick soldiers (war invalids, sick soldiers, people infected with 81% or more of severe toxic chemicals are exempted in section 1 above). War invalids, sick soldiers, people infected with 80% or less of toxic chemicals in 3 groups are reduced according to 3 levels in section 2 according to the provisions of Article 105 of the Decree. At the same time, it has added the group of people who participated in the resistance war and were awarded medals instead of previously only people awarded the First Class Medal were considered.

Thus, all meritorious people are considered for exemption or reduction of land use fees.

- Records, procedures and processes for resolving land use fee exemption and reduction: Implemented according to the provisions of the law on land use fee collection and the law on tax management.

6. Housing improvement support:

- Regarding subjects: Subjects receiving support for housing improvement are those specified in Points a, b, d, dd, e, g, h, i, k, l, m in Clause 1, Article 3 of the Ordinance and relatives of martyrs.

Which clearly stipulates: Subjects exempted from housing rent. Subjects and levels of housing rent reduction According to the provisions of Point 2, Point 3, Article 100, Decree No. 131/2021/ND-CP.

-Financial support for new construction or renovation and repair of temporary housing or severely damaged housing: Subjects, conditions, implementation methods, project preparation and approval procedures are similar to Decision No. 22/2013/QD-TTg dated April 26, 2013 of the Prime Minister on housing support for people with revolutionary contributions.

New point: Provincial People's Committees report to the Ministry of Construction, the Ministry of Planning and Investment, the Ministry of Finance and the Ministry of Labor - Invalids and Social Affairs with the Project attached. Next, the Ministry of Construction presides over and coordinates with the Ministry of Planning and Investment, the Ministry of Finance and the Ministry of Labor - Invalids and Social Affairs to synthesize and report to the Prime Minister for consideration and decision to arrange support capital from the central budget instead of the central budget supporting 95%, the local budget supporting 5% according to the prescribed level (new construction 40 million VND/household; repair 20 million VND/household).

7. Priority in land allocation or lease, water surface, sea areas; forest protection and development contracts; preferential loans for production and business; tax exemption or reduction:

- Beneficiaries and principles: People with meritorious services specified in Points d, dd, e, g, h, i, Clause 1, Article 3 and Clause 1, Article 38; Relatives of martyrs specified in Clause 2, Article 3, Ordinance on Preferential Treatment of People with Meritorious Services to the Revolution.

In case a person with meritorious services is also a relative of a martyr, he/she will only enjoy the highest benefits of one subject.

- Incentives: Priority in land allocation or lease, water surface, sea areas, forest protection and development contracts shall be implemented in accordance with the provisions of the law on land, sea, islands, resources, forest protection and development. Preferential loans for production and business shall be implemented in accordance with the provisions of the law on credit and banking.

Tax exemption or reduction is implemented according to the provisions of law on tax and tax administration.

- Documents, procedures, and settlement process: Individuals with a request attached with copies of the following documents must send it to the competent receiving authority: Certificate of meritorious person or decision to receive allowances and preferential allowances (for meritorious people). Certificate of martyr's relatives (for martyr's relatives).

Records and procedures for consideration and settlement of preferential treatment beneficiaries shall comply with the provisions of specialized laws.

8. Modify and supplement personal information in the meritorious person's profile:

- Applicable cases: Same as Circular 05/2013/TT-BLDTBXH and Circular 16/2014/TT-BLDTBXH.

New point: Additional provisions on beneficiaries of martyr worship allowance; martyr's spouse who remarries must request to amend or supplement personal information.

- Amendment principles: Similar to Circular 05/2013/TT-BLDTBXH and Circular 16/2014/TT-BLDTBXH. However, the new regulation stipulates: In case the competent agency or unit to amend or supplement information cannot be determined, the agency or unit managing the records is responsible for amending or supplementing information in the decision to enjoy preferential allowances.

- Documents and procedures: Same as Circular 05/2013/TT-BLDTBXH and Circular 16/2014/TT-BLDTBXH, only different forms.

9. Moving records when the beneficiary changes his/her permanent residence:

- Documents and procedures for moving (from Nghe An province to other provinces): According to Decree 131, individuals must submit an application with a copy of their citizen identification card or a certificate from the place of residence registration agency to the Department of Labor, War Invalids and Social Affairs where the documents are managed. However, to facilitate the monitoring and management of the subjects while still implementing the same as before, the Department of Labor, War Invalids and Social Affairs provides instructions on documents and procedures for moving as follows:

- Individuals make an application according to Form No. 27, Appendix I, Decree 131, with a certified copy of their citizen identification card or a certificate from the residence registration authority sent to the Department of Labor, War Invalids and Social Affairs.

- The Department of Labor, War Invalids and Social Affairs shall prepare a letter of introduction for payment of allowances and confirm the preferential regimes that have been and have not been enjoyed since which date, month, year, and attach the individual's profile to the Department of Labor, War Invalids and Social Affairs.
