In the middle of the night, he saw four feet clamped together. In a fit of jealousy, he beat his wife's driver to death.
Coming to Ho Chi Minh City to start a business, Dao married Nguyen Thi Thu Cuc (born in 1970 - from the same hometown of Quang Nam) in 1992.
After many years of living together, Dao and her husband had a conflict. In mid-2016, Ms. Cuc moved to District 12 to rent a house and brought all four children there to live. After that, Ms. Cuc hired Mr. T (born in 1978) as a driver and let him eat and stay at home for work convenience.

During this time, Dao often came here to eat and discovered that his wife was acting strangely, so he became jealous. When Dao asked her, she refused.
On the evening of February 21, 2017, Dao drove from Tan Binh district to district 12 to have dinner with his family. At this time, Dao saw Mr. T cleaning up the house, so she became even more jealous. Dao suggested to Ms. Cuc that she would move back here to live with the family the next day. However, Ms. Cuc firmly refused, so the conflict between the two became more and more tense. Ms. Cuc went out, and Dao also left.
At around 1am on February 22, 2017, Dao climbed over the wall and entered the house. Seeing that the main door was not closed, Dao tiptoed to the first floor and saw four feet clamped together. Dao thought those were her children's feet so she went downstairs to go home.
However, when going down to the ground floor, Dao discovered that the children were sleeping in this room. Dao immediately went back up to check by turning on the phone screen to observe carefully who those 4 feet belonged to. When discovering that the person lying next to his wife was the driver, Dao grabbed a piece of wood, ran up, shone the phone in the driver's face and hit him.
Hearing the noise, the wife woke up screaming and was also hit in the face by Dao with a stick, causing her to faint. The children discovered the incident, ran to stop it and hugged Dao.
Although he was taken to the emergency room by local people, Mr. T died due to severe brain trauma. As a result, Dao was prosecuted and charged with “Murder”.
At the recent first instance trial, Dao expressed remorse for his actions. In response to questions from the jury, Dao said, “The defendant suspected his wife of having an affair for a long time, but he had not caught her red-handed, so she denied it. All the assets he earned were given to his wife. More than 10 years ago, he suffered a stroke and his health was poor, so he could only help his wife a little, and could not make as much money as before. Knowing that his wife looked down on him, he requested a divorce many times, but she refused to sign. The defendant felt very bored living with his wife and seeing that situation, sometimes he got angry and yelled at his wife and children…”
Describing the incident, Dao said, “The defendant ran to the kitchen to find the murder weapon. There were many knives in the kitchen at that time, but the defendant did not intend to kill anyone, so he did not take the knife. When he saw the piece of wood, he grabbed it and only wanted to cause injury to the couple...”
However, when asked by the jury, the defendant's wife said, "He was unreasonably jealous. For more than 20 years of living together, he was jealous of anyone who was with me, then he cursed and beat his wife and children. I raised all four children by myself, he couldn't do anything... That day, the driver slept over, I had to watch the car that Mr. Dao left in the afternoon, so I brought a bowl of rice upstairs to sit and eat while watching, then I fell asleep, there was no love affair with the driver. Now, whoever does it has to take responsibility, but I don't have money to compensate the victim's family."
The defendant’s children also testified that the driver stayed overnight for work purposes, and was not having an affair with their mother. On the day of the incident, they did not know that their mother slept next to the driver because the children had gone to bed around 9:30 p.m. and usually on other days, their mother slept with them.
Maintaining the prosecution's viewpoint, the representative of the Ho Chi Minh City People's Procuracy requested the panel of judges to sentence the defendant to 12 to 14 years in prison. However, considering the case was complicated and many details needed to be clarified, after deliberation, the Ho Chi Minh City People's Court decided to return the case file for further investigation.
