Regulations on land for construction of works and areas with safety corridors

Article 210,Land Law 2024 stipulatesland for construction works, areas with safety corridorsas follows:

1. Land for construction works and areas with safety corridors include:

a) Land for construction of works and areas subject to protection corridors according to relevant laws and protection corridors for such works and areas;

b) Land for construction of national defense works, military zones and land in the protection corridor, protection area, safety belt of military works and zones according to the provisions of law on management and protection of national defense works and military zones.

2. The use of land for construction of works with safety corridors must ensure the combination of exploitation of both above-ground and underground areas, and the arrangement of different types of works on the same land plot to save land and comply with relevant legal provisions.

3. Land users in the safety corridors of construction works, protection areas, and safety belts may continue to use the land for the determined purposes and in accordance with the provisions of law; they must not obstruct the protection of the safety of construction works and areas with safety corridors, except in cases where relocation is required in accordance with the provisions of relevant laws.

In case the use of land in the safety corridor, protected area, or safety belt affects the safety protection of the construction or area with safety corridor, the construction owner or land user must take remedial measures. If remedial measures cannot be taken, the State will reclaim the land and compensate according to the provisions of law.

4. The agency or organization directly managing the construction or area with a safety corridor is responsible for publicly announcing the boundary markers of the safety corridor, area, and safety belt and is primarily responsible for protecting the safety of the construction or area with a safety corridor; in case the land in the safety corridor, protection area, or safety belt is encroached, occupied, or illegally used, it must promptly report and request the People's Committee of the commune where the safety corridor is encroached, occupied, or illegally used for handling.

Land use in protected areas and safety belts of defense works and military zones shall comply with the provisions of the Law on Management and Protection of Defense Works and Military Zones.

5. People's Committees at all levels where construction works and areas with safety corridors are located are responsible for coordinating with agencies and organizations directly managing construction works and areas to disseminate and popularize laws on safety protection of construction works and areas; publicly announce land use boundaries within safety corridors; promptly handle cases of encroachment, occupation, and illegal use of safety corridors of construction works and areas.

6. The Government shall detail this Article.
