Regulations on documents and procedures for settlement of social insurance benefits

(Baonghean) - On July 6, 2016, Nghe An Provincial Social Insurance issued Official Dispatch No. 1182/BHXH - CDBHXH on implementing Decision No. 636/QD - BHXH on promulgating Regulations on records and procedures for settling social insurance benefits.

Accordingly, the Provincial Social Insurance provides specific guidance on some additional contents in Decision No. 636/QD - Social Insurance; and at the same time notes some specific regulations as follows:

1. Sickness, maternity, and health recovery benefits

- Currently, the Ministry of Health has not issued a form and regulations on the authority to issue a Certificate of Confirmation of the medical facility in cases where female employees must take time off work to rest, female employees are no longer healthy enough to care for their children when giving birth, or in cases where the child is born under 32 weeks old or the child has to have a cesarean section. When there are regulations from the Ministry of Health, Nghe An Provincial Social Insurance will guide the units to implement.

- In the case of settling sickness and maternity benefits where the employee chooses to receive cash at the Social Insurance agency (cash payment for cases where the employee has not received it at the employer and the employer has returned it to the Social Insurance agency, and the employee does not have a personal account), the Social Insurance of the districts and the Financial Planning Department will arrange staff to pay the subject at the one-stop department.

- The employer clearly states the form of employee receiving the allowance in column C of the List of proposals for settlement of sickness, maternity, and health recovery benefits (Form C70a - HD). Note that in case the employee already has a bank account and wants to receive salary through the account, clearly state the account number and bank name in this section and provide an email address so that the Social Insurance agency can transfer the results (electronic copy) of List C70b - HD to the unit immediately after approval.

2. Retirement Mode:

- Voluntary pension benefit application in case of one-time payment for the missing years as prescribed in Point e, Clause 1, Article 9 of Decree 134/2015/ND-CP dated December 29, 2015 detailing a number of articles of the Law on Social Insurance on voluntary social insurance, including:

+ Social insurance book, separate sheet (for the period of voluntary social insurance payment at one time for 20 years, clearly state the period of voluntary social insurance payment for 20 years according to Circular 01/2016/TT - BLDTBXH dated February 18, 2016 of the Ministry of Labor, War Invalids and Social Affairs);

+ Application form No. 14 - HSB (original);

+ Certificate of full payment from the district Social Insurance or Receipt of one-time voluntary social insurance payment (copy).

- The residential address (contact address) in the Decision on retirement (Form No. 12 - HSB or Form issued under Decree No. 46/2010/ND-CP of the Government) and in the application (Form No. 14 - HSB) must fully state the house number, lane (alley, alley), street, group (village, hamlet), commune (ward, town), district (county, town, city), province (city).

3. One-time social insurance subsidy

- The subsidy level for the years of participating in social insurance before 2014 is 1.5 months of average salary for each year; from 2014 onwards, the benefit level is equal to 2 months of average salary for each year. In case the period of social insurance payment before January 1, 2014 has odd months, then the odd months will be transferred to the period of social insurance payment from January 1, 2014 onwards to be used as the basis for calculating one-time social insurance with the condition that the period of social insurance payment must be transferred to 2014; in case the entire period of social insurance payment before 2014, the odd months will not be counted to 2014.

- Do not consider re-processing of one-time social insurance benefit applications that have been properly processed and have received one-time social insurance benefits.

- The provincial Social Insurance Department resolves one-time social insurance benefits for pensioners and monthly social insurance benefits who settle abroad. The temporary settlement process is implemented according to the process for settling retirement, death, work accident, and occupational disease benefits.

4. Death benefit

- Column 4 of Family Declaration Form 09A-HSB requires clearly stating the actual income level from income sources such as: Salary, wages, pension or type of allowance or other specific sources of income;

- In case a relative receiving a lump sum allowance appoints a declarant to be their representative to declare and receive the allowance, all relatives are required to sign, write their full name or fingerprint on form 09A-HSB; in case there is only 01 relative eligible to receive a monthly allowance and chooses to receive a lump sum allowance, the declarant must be that relative. If the declarant is not a relative eligible to receive a monthly allowance, that relative is required to sign or fingerprint on the confirmation declaration about appointing a representative to declare and receive the allowance. In case the declarant does not sign the confirmation, the authorization letter for the declarant and recipient of the allowance must be attached (form 13-HSB) to have a basis for settlement in accordance with regulations; in case the relative chooses to receive the allowance through an ATM account, instructions are given to add form 14-HSB;

- In case the Social Insurance agency has received the dossier of relatives declaring the dossier for receiving death benefits according to the provisions of Official Dispatch No. 5435/BHXH-CSXH dated December 31, 2015 of Vietnam Social Insurance before January 1, 2016 to receive one-time benefits in the declaration with 02 or more relatives, it is not required to re-declare Form 09A-HSB issued with Decision 636/QD-BHXH but must add the minutes of the family meeting to appoint a representative to declare and receive the benefits.

5. Assessment of the level of loss of working capacity

- From January 1, 2016 onwards, people receiving occupational accident and disease benefits after their injuries or illnesses have returned and are stable, relatives of social insurance participants, pensioners, and deceased social insurance beneficiaries, and employees who are reserving their social insurance payment period can proactively go for assessment of the level of reduced working capacity. The social insurance agency will not refer the above cases for assessment of working capacity. Employees and their relatives can contact the Nghe An Provincial Medical Assessment Council for guidance on documents and procedures.

- The Social Insurance Agency shall pay the fee for assessing the level of labor capacity loss for the above cases if they are eligible for social insurance benefits. While waiting for instructions on payment procedures, the District Social Insurance Agency shall open a book to monitor these cases so that when there are instructions, the subjects submitting payment documents will be notified.
