Amending some regulations on fire prevention and fighting

The Government has issued Decree No. 50/2024/ND-CP amending and supplementing a number of articles of Decree No. 136/2020/ND-CP detailing a number of articles and measures to implement the Law on Fire Prevention and Fighting and the Law amending and supplementing a number of articles of the Law on Fire Prevention and Fighting and Decree No. 83/2017/ND-CP.

In particular, Decree No. 50/2024/ND-CP amends and supplements Clause 9, Article 9 of Decree No. 136/2020/ND-CP regulating the licensing and transportation of goods that are dangerous to fire and explosion. According to the new regulations, the license to transport goods that are dangerous to fire and explosion is valid nationwide and is valid for no more than 24 months for vehicles transporting goods that are dangerous to fire and explosion according to the plan or transportation contract and does not exceed the vehicle's usage period.

For design and design approval on fire prevention and fightingDecree No. 50/2024/ND-CP amending and supplementing a number of regulations.

Specifically, construction planning, new construction design, renovation or change of use of projects, works, design of motor vehicles with special requirements on ensuring fire prevention and fighting safety when manufacturing or converting new ones from all investment sources must comply with regulations, norms and standards on fire prevention and fighting. Construction design documents of projects, works, motor vehicles must be carried out by units that meet the conditions according to regulations and must be approved for fire prevention and fighting design.

Subjects subject to design review on fire prevention and fighting:

- Projects and works specified in Appendix V issued with Decree No. 50/2024/ND-CP when newly constructed or when renovated, changing the nature of use leading to one of the following cases: increasing the scale of the number of floors or area of ​​the fire compartment; changing the type and location of the escape stairs; reducing the number of escape routes of the floor, fire compartment, or work; installing new or replacing the fire alarm system; installing new or replacing the fire fighting system; changing the function to increase fire safety requirements for the floor, fire compartment, and work;

- Motor vehicles with special requirements on ensuring fire prevention and fighting safety as prescribed in Section 19 of Appendix V issued with Decree No. 50/2024/ND-CP when newly manufactured or converted, affecting one of the fire prevention and fighting safety requirements prescribed in Point c, Clause 5, Article 13.

Authority to approve fire prevention and fighting designs

Decree No. 50/2024/ND-CP stipulates that the Fire Prevention, Fire Fighting and Rescue Police Department reviews and approves fire prevention and fighting designs for projects and works specified in the Appendix issued with Decree No. 50/2024/ND-CP.

The Fire Prevention, Fire Fighting and Rescue Police Department reviews and approves fire prevention and firefighting designs for projects, constructions, and motor vehicles specified in the Appendix issued with Decree No. 50/2024/ND-CP in the management area and in cases authorized by the Fire Prevention, Fire Fighting and Rescue Police Department.

Authority to suspend operations of facilities that do not ensure fire prevention and fighting safety

Decree No. 50/2024/ND-CP also amends Clause 8, Article 17 of Decree No. 136/2020/ND-CP regulating the authority to temporarily suspend or suspend the operation of establishments, motor vehicles, households and individuals that do not ensure fire prevention and fighting safety.

According to the new regulations, the Chairman of the People's Committee at the commune level decides to temporarily suspend or suspend the operation of each part or the entire facility, motor vehicle, household, or individual's activities within the scope of his/her management responsibility.

The Head of the Fire Prevention, Fire Fighting and Rescue Police Department of the provincial-level Public Security and the Head of the District-level Public Security, within the scope of their authority, shall decide to temporarily suspend or suspend the operation of each part or the entire facility, motor vehicle, household, or individual activities within the scope of their management responsibility, except for defense facilities operating for military purposes and motor vehicles with special requirements on ensuring fire prevention and fighting safety manufactured or converted by defense facilities specifically for military activities.

Police officers and soldiers are temporarily suspended from work in the cases specified in Point a, Clause 1, Article 17 and within the shortest time after the temporary suspension, must report to the direct competent manager mentioned above to make a decision on temporary suspension.
