The Government has issued Decree No. 50/2024/ND-CP amending and supplementing a number of articles of Decree No. 136/2020/ND-CP detailing a number of articles and measures for the implementation of the Law on Fire Prevention and Fighting and the Law amending and supplementing a number of articles of the Law on Fire Prevention and Fighting and Decree No. 83/2017/ND-CP.

Specifically, Decree No. 50/2024/ND-CP amends and supplements Clause 9, Article 9 of Decree No. 136/2020/ND-CP regulating the licensing and transportation of flammable and explosive hazardous goods. According to the new regulations, the license for transporting flammable and explosive hazardous goods is valid nationwide and for no more than 24 months for vehicles transporting such goods according to the transportation plan or contract, and not exceeding the vehicle's service life.

Regarding the design and design review of fire prevention and firefighting systems.Decree No. 50/2024/ND-CP amends and supplements a number of regulations.

Specifically, construction planning, new construction design, renovation or change of intended use of projects and works, and design of motorized vehicles with special requirements for fire safety during new manufacturing or modification, regardless of investment source, must comply with regulations, standards, and norms on fire prevention and fighting. Design documents for construction projects, works, and motorized vehicles must be prepared by a qualified unit as prescribed by regulations and must undergo fire safety design review and approval.

Subjects to fire safety design review:

- Projects and works specified in Appendix V issued with Decree No. 50/2024/ND-CP, when newly constructed or when renovated or having their intended use changed, may result in one of the following cases: increasing the number of floors or fire compartment area; changing the type or location of escape staircases; reducing the number of escape routes on a floor, fire compartment, or building; installing or replacing a fire alarm system; installing or replacing a fire extinguishing system; changing the function to enhance fire safety requirements for the floor, fire compartment, and building;

- Motor vehicles with special requirements for fire safety and prevention as stipulated in Section 19 of Appendix V issued with Decree No. 50/2024/ND-CP, when newly manufactured or modified, may affect one of the fire safety and prevention requirements stipulated in Point c, Clause 5, Article 13.

Authority to review fire prevention and firefighting designs

Decree No. 50/2024/ND-CP stipulates that the Fire Prevention, Fighting and Rescue Police Department shall review fire prevention and fighting designs for projects and works specified in the Appendix attached to Decree No. 50/2024/ND-CP.

The Fire Prevention, Firefighting and Rescue Police Department reviews fire prevention and firefighting designs for projects, constructions, and motor vehicles as stipulated in the Appendix attached to Decree No. 50/2024/ND-CP within its jurisdiction and in cases authorized by the Fire Prevention, Firefighting and Rescue Police Department.

Authority to suspend the operation of facilities that do not ensure fire safety.

Decree No. 50/2024/ND-CP also amends Clause 8, Article 17 of Decree No. 136/2020/ND-CP, which stipulates the authority to temporarily suspend or permanently suspend the operation of establishments, motorized vehicles, households, and individuals that do not ensure fire safety.

According to the new regulations, the Chairman of the People's Committee at the commune level decides on the temporary suspension or permanent suspension of operations for individual departments, entire establishments, motorized vehicles, households, and activities of individuals within their area of ​​responsibility.

The Head of the Fire Prevention, Firefighting and Rescue Police Department of the Provincial Public Security, and the Head of the District Public Security, within their respective jurisdictions, may decide to temporarily suspend or permanently suspend the operation of individual departments, entire facilities, motorized vehicles, households, and the activities of individuals under their management responsibility, except for national defense facilities operating for military purposes and motorized vehicles with special fire safety requirements manufactured or modified by national defense facilities specifically for military operations.

Police officers and soldiers may be temporarily suspended from duty in the cases stipulated in point a, clause 1, Article 17, and within the shortest possible time after the temporary suspension, they must report to their direct supervisor with the authority mentioned above to issue the temporary suspension decision.
