The Resolution on the arrangement of district and commune-level administrative units for the 2019-2021 period was passed by the National Assembly Standing Committee (NASC) on the afternoon of March 12 with 100% approval.

District and commune-level administrative units subject to rearrangement are administrative units with natural area and population size that do not meet 50% of the standards prescribed in Resolution No. 1211/2016/UBTVQH13 dated May 25, 2016 of the Standing Committee of the National Assembly on standards of administrative units and classification of administrative units.

Currently, 16 districts and 631 wards and communes have not met 50% of the standards on natural area and population and need to be rearranged and merged. The rearrangement will be basically completed in 2019.

There are special cases.

The provincial People's Committee is responsible for reviewing and reporting to the Government for consideration and decision on whether to reorganize district- and commune-level administrative units subject to regulations if they have one of the following specific factors: Having a geographical location separate from other administrative units; Formed and stabilized since 1945; Having an important position in terms of national defense and security or having characteristics in terms of historical traditions, culture, ethnicity, religion, beliefs, customs and practices that are not favorable for reorganization.

In special cases, it is possible to arrange district and commune-level administrative units to establish new administrative units that do not meet the standards on natural area and population size as prescribed but fall into the following cases: Having special factors in terms of historical traditions, culture, ethnicity, religion, beliefs, customs, practices, geographical location, natural conditions, residential community or requirements to ensure national defense and security; Being established on the basis of merging 3 or more administrative units of the same level; Being established on the basis of merging 2 administrative units of the same level but due to the actual situation, it is not possible to merge other adjacent administrative units.

The provincial People's Committee shall send the contents of the plan and proposal for the arrangement of relevant administrative units to the district and commune People's Committees to collect voters' opinions. The voter list shall be posted within 15 days before the date of collecting voters' opinions.

“The People's Committees at district and commune levels must complete the collection of voters' opinions and the results of the collection of voters' opinions must be sent to the People's Committees at higher levels and the People's Councils at the same level within 20 days from the date the Provincial People's Committee sends the plan, proposal for the arrangement of administrative units and the opinion collection form” - the Resolution clearly states.

On that basis, the People's Councils at provincial, district and commune levels in relevant administrative units discuss and vote on whether to approve or disapprove the policy of rearranging administrative units in order from commune level to district and provincial level.

Temporary suspension of staff appointments

The Resolution requires a temporary suspension of the election and appointment of leadership and management positions and the recruitment and acceptance of cadres, civil servants and public employees at agencies, organizations and units of district and commune-level administrative units subject to rearrangement from the effective date of this Resolution, except in cases where there is a vacancy of a head and no person in charge can be arranged according to the provisions of law.

No later than 60 days from the effective date of the resolution of the Standing Committee of the National Assembly on the arrangement of each administrative unit, agencies, organizations and units in the new administrative unit must complete the arrangement and consolidation of the organizational apparatus.

When developing a reorganization plan, it is necessary to evaluate, classify, plan the arrangement and assign tasks to appropriate cadres, civil servants and public employees, in conjunction with the implementation of staff streamlining; the arrangement of the number of leaders, managers and cadres, civil servants and public employees in new agencies, organizations and units must have a reasonable roadmap.

Regarding the regime and policies for the contingent of cadres, civil servants, public employees and redundant workers, the Resolution clearly states that they must comply with the Government's regulations on recruitment, use and management of cadres and civil servants; on the termination regime; on the policy of streamlining the payroll and other policies.

In addition, based on the local budget balance, the provincial People's Committee shall submit to the People's Council of the same level to issue support policies for redundant cadres, civil servants, public employees and workers./.

Unconverted documents are still used

People's Committees at all levels must proactively implement and create favorable conditions for individuals and organizations when carrying out procedures to convert documents and not collect fees when converting due to changes in administrative boundaries.

In case individuals and organizations have not converted, the documents previously issued by competent authorities according to the old administrative unit, if not expired according to regulations, can still be used in the new administrative unit.
