Government Inspectorate points out violations of Chairman of Thai Binh Provincial People's Committee
In Thai Binh, the regular reception of citizens by the Chairmen of the People's Committees of Vu Thu, Kien Xuong, Thai Thuy districts and the Departments of Labor, War Invalids and Social Affairs and Construction is not fully in accordance with regulations.
The Government Inspectorate has just issued Inspection Conclusion No. 1137/KL-TTCP on the inspection of the responsibility of the Chairman of the People's Committee of Thai Binh province in implementing the law on inspection, citizen reception, complaints, denunciations and corruption prevention and control (period from 2011 to 2016) and land and environment (period from 2006 to 2016).

According to the inspection conclusion announcement, in addition to the achieved results, the Chairman of the People's Committee of Thai Binh province and the province's functional agencies still allowed many shortcomings and violations to occur.
Specifically, the Government Inspectorate pointed out that the issuance of guiding documents and directives on this work in a number of departments and branches is still limited in number; the propaganda and dissemination of laws have not been effective; and the awareness and responsibility of a number of cadres and civil servants are still limited.
Inspection and responsibility checking work has not been carried out regularly, and some units have not yet organized and implemented it; the capacity and skills of some cadres and civil servants performing this work have not yet met the requirements of the task.
The regular reception of citizens by the Chairmen of the People's Committees of Vu Thu, Kien Xuong, Thai Thuy districts and the Departments of Labor, War Invalids and Social Affairs and Construction was not in accordance with regulations; no notice of conclusion of the reception of citizens was issued...
Some complaints and denunciations under the authority of departments, branches and district levels are still slow to be resolved; the order and procedures for resolution are not in accordance with regulations.
Some inspections at the department, sector and district levels are still prolonged; the inspection and supervision of the implementation of conclusions, recommendations and post-inspection handling decisions are not thorough; the recording of inspection logs is not in accordance with regulations; the inspection and examination of compliance with regulations on corruption prevention and control and the detection and handling of corrupt acts are not very effective; the declaration and transparency of assets and income at some units are still formalistic...
The Government Inspectorate's inspection conclusion notice also pointed out many issues in the compliance with legal regulations in land management and use by State agencies, organizations, households and individuals in Thai Binh province.
A typical example is the Nguyen Duc Canh residential area project in Diem Dien town, Thai Thuy district. During the implementation process, the Thai Thuy District People's Committee approved the compensation and support plan and paid part of the money to the people but did not issue a land recovery decision (in 2005), leading to complaints from some households.
In addition, the project has been delayed for many years due to problems with site clearance and the People's Committee of Thai Thuy district unable to arrange finances to implement the project.
The fact that the People's Committee of Thai Binh province issued Document No. 2788 dated August 3, 2016 assigning the joint venture of Phu Hung Import-Export Production Joint Stock Company and Lam Son Thai Binh Joint Stock Company as the investor, while not yet handling the case of previously assigning the People's Committee of Thai Thuy district as the investor, is not carrying out the procedures according to the provisions of the law on investment...
In districts of Thai Binh province, there are still cases of land allocation without authority; land use purpose change without permission from competent authorities; encroachment and illegal construction of houses on agricultural land; construction of public works without land allocation decisions...
A series of violations in the implementation of projects were also pointed out by the Government Inspectorate. Typically, at the urban area project west of National Highway 10 in Dong Hung district, according to the loan contracts and payments to the construction contractor, the People's Committee of Dong Hung district mobilized 50.33 billion VND, equivalent to an area of 40,762m2 of land to be handed over to the companies that had advanced capital.
The Government Inspectorate affirmed that the allocation of land without auction is a violation of the provisions of the 2003 Land Law. In addition, it is necessary to continue to inspect and clarify the management and use of the amount of 50.33 billion VND that the People's Committee of Dong Hung district received from capital contributing companies and construction contractors related to the project implementation process...
In the social housing project invested by Urban Development and Construction Company 379, the People's Committee of Thai Binh province used both the parking lot area and the commercial residential land area to calculate the 20% of commercial land area exempted from land use fees, which is not in accordance with the law.
The investor was assigned land in 2009, but it was not until 2017 that the provincial authorities determined that the land use fee to be paid was a violation of the provisions of Circular 76 dated June 16, 2014 of the Ministry of Finance.
In addition, the project to build and operate the infrastructure of Ky Ba market, Thai Binh city, at the time of inspection, had not yet completed procedures on land, investment, construction and financial obligations; there was no construction permit but in fact the technical infrastructure had been completed, the rough construction of the commercial townhouses and kiosks had been completed.
The conclusion notice clearly stated that the shortcomings and problems in the leadership and direction of the implementation of the above-mentioned legal provisions on inspection, citizen reception, complaints, denunciations and corruption prevention and control belong to the head, namely the Chairman of the Provincial People's Committee; Chairmen of the People's Committees of districts and cities; Directors of Departments and branches; Chief Inspectors at all levels and branches and Heads of relevant advisory agencies and units.
The Government Inspectorate requested the Chairman of the People's Committee of Thai Binh province to seriously implement the recommendations of the Government Inspectorate in Conclusion No. 1137/KL-TTCPP to rectify and overcome shortcomings and limitations, improve the effectiveness of inspection work, receive citizens, resolve complaints and denunciations, prevent and combat corruption, and manage the state on land and environment.
The Chairman of the People's Committee of Thai Binh province reports to the Prime Minister the implementation results before December 31, 2019./.
