Change of authority to sign Certificate of land use rights and house ownership from May 20, 2023
(Baonghean.vn) - Nghe An Department of Natural Resources and Environment issued Document No. 3236/TB-STNMT dated May 19, 2023 notifying the change in authority to sign Certificates of land use rights, house ownership and other assets attached to land, confirming changes to the signed Certificates in Nghe An.
In the above document, the Department of Natural Resources and Environment of Nghe An said: Implementing Clause 5, Article 1, Decree No. 10/2023 dated April 3, 2023 of the Government on amending and supplementing a number of articles of the Decrees guiding the implementationLand LawEffective from May 20, 2023, the Department of Natural Resources and Environment of the province announces the change of authority to sign the Certificate of land use rights (QSD), house ownership rights and other assets attached to land (hereinafter referred to as the Certificate); confirms changes to the signed Certificate in Nghe An for the cases specified in Clause 4, Article 95, Clause 3, Article 105, Land Law, from May 20, 2023 as follows:

+ Land Registration OfficeThe Department of Natural Resources and Environment is responsible for issuing certificates and confirming changes to issued certificates for organizations, religious establishments, overseas Vietnamese implementing investment projects; foreign organizations and individuals, and foreign-invested enterprises. The time for performing administrative procedures on land previously by the Department of Natural Resources and Environment is added to the time for performing administrative procedures by the Land Registration Office.

+ Branch of Land Registration OfficeDistricts, cities, and towns issue certificates and confirm changes to the certificates already issued to households, individuals, residential communities, and overseas Vietnamese who are allowed to own houses attached to land use rights in Vietnam. The time for carrying out previous land administrative procedures by the Land Registration Office is added to the time for carrying out administrative procedures of theBranches of Land Registration Offices of districts, cities and towns.
Branches of the Land Registration Offices of districts, cities and towns only issue Certificates and confirm changes to Certificates when the first Certificate is issued in accordance with the provisions of law. In case the first Certificate is issued incorrectly, the revocation of the issued Certificate and re-issuance of the first Certificate are the responsibility of the People's Committees of districts, cities and towns.

+ Land Registration Office, Branch of Land Registration OfficeDistricts, cities and towns are allowed to use their seals to issue Certificates and confirm changes to issued Certificates.
Previously, according to Decision No. 694/QD-STNMT dated May 19, 2023, the Director of the Department of Natural Resources and Environment of Nghe An province terminated the implementation of Decision No. 1763/QD-STNMT dated December 30, 2022 of the Director of the Department on authorizing the issuance of Certificates of land use rights, house ownership rights and assets attached to land to households and individuals in the area for reasons that are not consistent with the provisions of Decree No. 10/2023/ND-CP of the Government amending and supplementing a number of articles of the Decrees guiding the Land Law. The Decision takes effect from May 20, 2033.
