Prime Minister: Determined to eliminate group interests dominating policy

The Prime Minister emphasized: "In the spirit of creating conditions for people and businesses, we must resolutely eliminate group interests that dominate policies."

This is an important meeting to assess the status of promulgating documents detailing the implementation of laws effective from July 1, 2016, the Investment Law and the Enterprise Law.

According to the Government Office, the number of outstanding documents and documents detailing laws that will take effect from July 1 that are still lacking and need to be issued is 30 documents. Of these, 26 documents have been submitted to the Prime Minister. Regarding the Decrees regulating investment and business conditions detailing the Enterprise Law and the Investment Law, 50 Decrees need to be issued. Up to now, 49 Decrees have been submitted to the Government.

Summarizing the recommendations of enterprises, Mr. Vu Tien Loc, Chairman of the Vietnam Chamber of Commerce and Industry, suggested that when issuing detailed regulations, the authorities should "rather omit than tighten" to create favorable conditions for enterprises and people. In addition, regulations that are still uncertain between pre-audit and post-audit should be changed to post-audit. At the same time, regulations that are uncertain whether to regulate or let the market self-regulate should be left to enterprises or people to self-regulate.

At the meeting, Prime Minister Nguyen Xuan Phuc emphasized that to build a creative government, institutional building is very important, aiming to create favorable conditions for people and businesses, liberate production capacity, promote economic growth and development.

But at the same time, an important thing is to have things that the State manages through institutional policies to create a legal corridor for good development, without abusing the negative aspects of the market economy. This is a difficult task in law-making, especially in building new institutions to replace old regulations. But the spirit is to create all favorable conditions for people and businesses to develop production and business.

Emphasizing that the Government's key task is to build institutions, the Prime Minister assessed that ministries and branches have submitted documents detailing laws that will take effect from July on schedule.

The Prime Minister requested that, despite the large number of detailed regulations and Decrees to be completed, quality must still be ensured. Old regulations must not be "copy-pasted" into new Decrees, but solutions must be found to create real conditions for people and businesses.

The Prime Minister assessed that it is important that despite shortening procedures, the regulatory documents have followed the correct procedures as prescribed by the Law on Promulgation of Legal Documents, and have fully and widely consulted businesses and subjects subject to the Law.

For all remaining documents that have not been issued, the Prime Minister suggested that even though they are shortened, they must follow the correct procedures and receive wide consultation, focusing on subjects within the scope of regulation.

The Prime Minister directed the Ministers to focus on this work and not be conservative but be straightforward, creating favorable conditions for production and business. In which, it is necessary to distinguish between technical standards and production and business conditions. If there are different opinions, they must be thoroughly consulted. The team implementing the Enterprise Law and Investment Law must analyze and submit it soon. If there are still different opinions, they must be submitted to the Prime Minister and the Deputy Prime Ministers in charge for decision.
