Effective implementation of the Law on Property Auction 2016

Law on Property Auction No. 01/2016/QH14 was passed by the 14th National Assembly on November 17, 2016, consisting of 8 chapters and 81 articles. The promulgation of the Law aims to create a stable, unified, and long-term legal basis for the development of property auction activities in the direction of professionalization; improve the quality of the auctioneer team, property auction organizations, and the quality of property auction activities; promote the development of property auction services in the system of service sectors and fields according to the market mechanism. In addition, the implementation of the Law aims to strengthen the mechanism to protect the legitimate rights and interests of auction participants, the responsibilities of auctioneers and property auction organizations; and improve the quality and effectiveness of state management of property auctions.

At the conference, delegates were informed by comrade Nguyen Thi Mai - Deputy Director of the Department of Judicial Support, Ministry of Justice about the basic contents of the Law such as: Principles of auction and prohibited acts; regulations on auctioneers, order, procedures, organization of property auctions; auction service fees, property auction costs; handling of violations, cancellation of property auction results, compensation for damages; state management of auctions...

Accordingly, the Law on Property Auction stipulates that auctioned assets include assets that the law requires to be sold through auction and assets owned by organizations and individuals who voluntarily choose to sell through auction. For assets that the law requires to be sold through auction, the Law specifically lists these types of assets based on a review of regulations in specialized laws to ensure publicity and transparency, serving as a basis for agencies, organizations and individuals to comply with the procedures prescribed in the Law on Property Auction when auctioning such types of assets.

Speaking at the conference, comrade Le Xuan Dai - Standing Vice Chairman of the Provincial People's Committee assessed that in recent years, asset auction activities have revealed many limitations and shortcomings such as: The quality of auction services is not yet effective, there is still collusion, agreement to lower prices... for profit, especially in land use rights auctions; The quality of the auction team is still uneven, asset auction enterprises are small-scale, fragmented, and unprofessional.

The Standing Vice Chairman of the Provincial People's Committee said: In order to promptly implement the Law on Property Auction in the province, the People's Committee of Nghe An province issued Decision No. 2051/QD-UBND dated May 17, 2017 approving the Plan to implement the Law on Property Auction in the province.

The plan has identified a number of work contents that need to be focused on implementing in preparation for the unified and effective application of the Law on Property Auction immediately after the Law comes into effect. The Standing Vice Chairman of the Provincial People's Committee requested delegates to seriously absorb all the basic contents of the Law on Property Auction to effectively organize and implement it in their respective sectors and localities.

After this conference, it is recommended that departments, branches, People's Committees of districts, cities and towns, based on the plan to implement the Law of the Provincial People's Committee and the practical situation of the industry and locality, effectively implement the Law on Property Auction in their industry and locality; Organize the implementation and dissemination of the content of the Law to agencies, organizations and cadres, civil servants, public employees and workers in the industry and locality; Strengthen coordination in the process of property auction to promptly and thoroughly prevent the situation of brokers, collusion to lower prices, handle or propose strict handling of violations./.
