Prosecution of former prison officer for letting prisoner escape from prison in Ha Giang

The Supreme People's Procuracy has just issued an indictment to prosecute the defendant Doan Thai Son (born in 1994, former prison officer of Quang Binh District Police, Ha Giang Province - has been stripped of the title of People's Police) for the crime of "Lack of responsibility allowing arrested people, people in temporary detention, temporary imprisonment, people serving prison sentences to escape" as prescribed in Article 376, Clause 2, Point d - Penal Code 2015.

According to the indictment, Then Thi Huong (born in 1986, residing in Hong Quan village, Viet Hong commune, Bac Quang district, Ha Giang province) is the subject serving Judgment No. 47/2005/HSST dated December 12, 2005 of the People's Court of Ha Giang town with a sentence of 1 year in prison for the crime of "Theft of property" and Judgment No. 457/2017/HSST dated December 27, 2017 of the People's Court of Thai Nguyen city (Thai Nguyen province) with a sentence of 12 years in prison for the crime of "Fraudulent appropriation of property".

Combining the two sentences, Then Thi Huong must serve 13 years in prison at Phu Son 4 Prison, Ministry of Public Security.

On November 20, 2018, Then Thi Huong was taken from Phu Son 4 Prison, Phu Luong District, Thai Nguyen Province, to the detention house of Quang Binh District Police, Ha Giang Province, to be tried for the crime of "Forgery of seals and documents of agencies and organizations".

On November 22, 2018, the People's Court of Quang Binh District, Ha Giang Province, tried and sentenced Then Thi Huong to 1 year in prison. Combined with the two sentences above, Then Thi Huong must serve a total sentence of 14 years in prison and continue to be detained at the Quang Binh District Police Detention Center to await the verdict taking legal effect.

Doan Thai Son is a prison officer, assigned to manage the locking, opening, and locking of the cells, held at the Quang Binh District Police Detention Center, Ha Giang Province, from November 30, 2018 to December 3, 2018.

At about 5:00 p.m. on December 1, 2018, Doan Thai Son opened the gate of the Detention Center to distribute food to the prisoners but did not lock the gate.

Then, Son continued to open the cell door of prisoner Then Thi Huong to let the prisoner out of the cell to receive food without the order of the Head of the detention facility.

At the same time, Son opened another cell door but forgot to lock prisoner Huong's cell door, allowing Then Thi Huong (a prisoner serving a 14-year prison sentence, a very serious crime) to take advantage of the situation and escape.

It was not until December 7, 2018, that Quang Binh District Police (Ha Giang Province) arrested Then Thi Huong.

The prosecution agency determined that during the investigation, Doan Thai Son honestly confessed his crime. After Then Thi Huong escaped, Doan Thai Son actively participated in the pursuit of the subject./.
