Female doctor prosecuted for causing genital warts in 103 children

The People's Procuracy of Hung Yen province has just issued an indictment to prosecute female physician Hoang Thi Hien (49 years old, in Khoai Chau, Hung Yen province) for violating regulations on medical examination and treatment as prescribed in Article 242 of the 1999 Penal Code.

According to the case file, Ms. Hien (born in 1969, in Yen Vinh village, Da Trach, Khoai Chau, Hung Yen) worked as a nurse at Me So commune health station (Khoai Chau district, Hung Yen) from 1995 to the end of December 2014 and was granted a certificate of practice by the Hung Yen Department of Health to practice nursing techniques until 2014.
To earn more income, at the end of 2013, Ms. Hien prepared specialized equipment to treat genital diseases of children at home. The fee ranges from 300,000 to 520,000 VND/time.
Since 2015, despite not having the necessary qualifications and a license to operate, Ms. Hien has continued to examine and treat genital diseases for children in Khoai Chau and Yen My districts.The main examination is to perform a procedure to dilate the foreskin to avoid the risk of infection and diseases related to the genitals.
Accordingly, from 2016 to July 2017, Ms. Hien performed the procedure on 103 children. However, after a while, the children began to develop small pimples on their genitals, so their parents took them to the hospital for examination. After the doctor diagnosed the children with genital warts, the parents filed a complaint with the Hung Yen Provincial Police Department.
Hung Yen Department of Health later determined that Ms. Hien provided medical examination and treatment services without a license, practiced beyond her professional scope, and sold medicine to patients at the medical examination and treatment facility.
On July 10, 2017, the Investigation Agency of Hung Yen province decided to request an examination at the Central Institute of Hygiene and Epidemiology to determine the cause of illness for 103 children in the area.
On July 26, 2017, Ms. Hien was administratively fined by the Chairman of the People's Committee of Hung Yen province for violating medical standards.

During the investigation, based on the testimony and related evidence, the authorities determined that Ms. Hien violated the regulations on medical examination and treatment, so the decision on administrative fine was canceled to continue the investigation.

According to the indictment, during the circumcision procedure, the female doctor used metal forceps, scissors, and other tools on many different children without properly sterilizing them, resulting in 103 children contracting genital warts.
The indictment also stated that some of the tools Ms. Hien used to perform procedures on the children contained the HPV virus, which was the direct cause of the children getting genital warts in large numbers.
The Central Dermatology Hospital determined that the amount of money for free treatment for 103 children was more than 390 million VND.
Ms. Hien's behavior was determined to have violated State regulations on medical examination and treatment, affecting the health and normal development of young children.
The indictment determined that Ms. Hien's work was against regulations, without a business license, lacking expertise and not ensuring sterile hygiene of instruments, causing especially serious consequences./.
