Illegal construction in Cua Lo is a systematic violation.

(Baonghean) - The Duc Xuan parish arbitrarily mobilized forces to build a chapel in block 8, Nghi Tan ward (Cua Lo town) is a systematic violation. Previously, although not approved to rebuild Xuan Mai parish, the Pastoral Council (HDMV) of Duc Xuan parish still deliberately organized illegal religious activities to gradually legalize the separation of the parish.

Mr. Hoang Van Sang - Chairman of the Duc Xuan Parish Pastoral Council incited parishioners and insulted the authorities.

With the tradition of national solidarity and harmony, the Vietnamese State in general and Nghe An province in particular always respect and ensure the freedom of belief of citizens. In Section 3, Article 3, Chapter 2, Decree 92/2012-ND-CP also clearly stipulates: "People participating in religious activities have the responsibility to practice a civilized lifestyle and comply with the law".

However, what is happening in Duc Xuan parish, Tan Loc parish (in Nghi Tan ward, Cua Lo town) is not like that. Specifically: on September 3, 2016, Duc Xuan parish, Tan Loc parish had a petition to rebuild Xuan Mai parish, but before that, in August 2016, all 32 parishioners in block 8, Nghi Tan ward (Cua Lo town) held a meeting and elected the provisional Executive Committee of the parish.

Next, Nghe An Provincial People's Committee issued Official Dispatches 8079 dated October 25, 2016 and 518 dated January 24, 2017 affirming: "There are not enough conditions to approve the proposal to establish Xuan Mai parish. Because the number of parishioners is not large (only about 32 households with 135 people); the distance from Block 8, Nghi Tan Ward to Duc Xuan parish church (recently built) is only about 500 - 600m". At the same time, affirming: the current planning and land fund of the locality do not have the conditions to assign the parish to build a worship facility if the parish is established".

However, Duc Xuan parish and Tan Loc parish still did not comply and issued a document stating: "If the government no longer has land to grant for the reconstruction of Xuan Mai parish church, we will take care of it ourselves...", and in fact, they systematically carried out violations.

Typically, on the night of November 30, 2016, priest Phan Sy Phuong - Parish Priest of Tan Loc organized an illegal prayer ceremony for about 200 parishioners at the house of Mrs. Nguyen Thi Dinh (Block 8, Nghi Tan Ward, Cua Lo Town). The content of the prayer ceremony affirmed that the parish would re-establish Xuan Mai parish to serve the religious activities of the people.

It is worth mentioning that upon receiving information that a prayer ceremony would take place at Mrs. Dinh's house in the evening, on the afternoon of November 30, 2016 (at 2:30 p.m.), Nghi Tan Ward People's Committee established a working group to directly meet with Father Phan Sy Phuong and the Parish Pastoral Council.

At the meeting, priest Phan Sy Phuong said: “The establishment of Xuan Mai parish was due to the wishes of the parishioners of grade 8; the construction of the church was thanks to external funding unrelated to the parishioners’ contributions. It is expected that the church will cost more than 2 billion VND…”.

At 4:00 p.m. the same day, the working group of Nghi Tan ward continued to work with Mr. Hoang Van Sang - Chairman of the Board of Directors of Duc Xuan parish. At the meeting, Mr. Sang said that "The Provincial People's Committee must be responsible for returning the land to Xuan Mai parish; if it does not allow the construction, it will call on Tan Loc parish to build a fence around the house of Mrs. Nguyen Thi Dinh to proceed with the construction".

Then, on the night of November 31, 2016, on the occasion of the Patron Saint's Day of Duc Xuan parish, the Pastoral Council of Duc Xuan parish mobilized about 500 people to carry the statue of the Virgin Mary to the porch of Mrs. Nguyen Thi Dinh's house. Regarding this, the People's Committee of Nghi Tan ward issued Notice No. 07 to parish priest Phan Sy Phuong and Duc Xuan parish stating: "The priest and the Pastoral Council organizing for parishioners to carry the statue of the Virgin Mary from Duc Xuan church (block 7) to Mrs. Nguyen Thi Dinh's family (block 8) without the approval of the Town People's Committee is contrary to the provisions of Decree No. 92/2012/ND-CP dated November 8, 2012 of the Government detailing and implementing the Ordinance on Religious Beliefs".

The fact that priest Phan Sy Phuong and the Pastoral Council of Duc Xuan parish organized prayer activities and a procession of the Virgin Mary's statue to the porch of Mrs. Nguyen Thi Dinh's house was against the law and affected the image of the church. In fact, Duc Xuan parish has a spacious church that was newly rebuilt and inaugurated in 2016, so why did they have to organize prayer activities and a procession of the Virgin Mary's statue to the porch of a private house (only 500 - 600m from the church)?

According to Article 25 of Decree No. 92/2012/ND-CP regulating religious activities outside the registered program of grassroots religious organizations: Point b, Clause 1 stipulates: Religious activities with the participation of believers in districts, towns, provincial cities, grassroots religious organizations must be approved by the People's Committee of the district where the religious activities take place; Clause 2 stipulates: Grassroots religious organizations are responsible for sending a written request to the competent authority specified in Points a and b, Clause 1 of this Article, clearly stating the name of the religious activity, organizer, expected number of participants, content of the activity, time, location of the activities, and conditions to ensure.

In Notice No. 07 dated January 18, 2017, Nghi Tan Ward People's Committee requested the parish priest and the Pastoral Council of Duc Xuan parish to "not let similar actions recur in the future and direct parishioners to bring the statue of the Virgin Mary back to Duc Xuan parish church" in accordance with regulations.

However, immediately after that, from March 19 to 26, with the peak being March 25, 2017, Duc Xuan parish mobilized forces to arbitrarily level the ground and build a chapel on plot number 54 of map sheet number 2 in block 8, Nghi Tan ward, even though it had not been granted a construction permit nor had it received the consent of the authorities and local government.

During the illegal construction of the chapel, when the local government and functional forces came to propagate, mobilize and make a record of suspension, Mr. Hoang Van Sang - Chairman of the Pastoral Council of Duc Xuan parish had words to incite parishioners, insulting those on duty...

This shows that the violations that occurred in Duc Xuan parish (Tan Loc parish) were carried out systematically with the purpose of turning residential land into a chapel. These are illegal acts, causing instability in social order in the area.
