Appeal trial of the massacre of 6 people in Binh Phuoc

On July 18, the High People's Court in Ho Chi Minh City opened an appeal trial in the murder case of 6 people in Binh Phuoc to consider the appeals of the two defendants and the victims' families.

Accordingly, after the first instance verdict of the People's Court of Binh Phuoc province, the two defendants Vu Van Tien and Tran Dinh Thoai appealed for a reduced sentence.

The victim's family appealed to increase the sentence for defendant Tran Dinh Thoai and requested consideration of the criminal responsibility of Ms. Tran Thi Trinh (aunt of defendant Nguyen Hai Duong).

The victim’s family believes that Ms. Trinh was involved in Duong’s crime, and that Ms. Trinh was the one who lent Duong his motorbike on the night of the crime. The defendant Nguyen Hai Duong accepted the death penalty and did not appeal, but attended the trial as part of his obligation related to the content of the appeal.

Previously, Ms. Tran Thi Trinh had filed a request to postpone the trial because she had just given birth. At today's trial, the defendant's defense attorney Vu Van Tien argued that Ms. Trinh was the person the victim's family appealed to review criminal liability, so if Ms. Trinh was absent, the trial should be postponed.

After consideration, the Appellate Court held that although Ms. Trinh was absent, it was not necessary to postpone the trial and the trial continued.

During the questioning and answering session of the Trial Council regarding the appeal request, Mr. Nguyen Le Vinh, representative of the victim's family, requested that the Trial Council consider the signs of "not reporting the crime" by Ms. Trinh and stated that she knew that Duong committed the crime.

For Thoại, Mr. Vinh requested an increased penalty because he "did not report Dương's actions when he knew about the plot" and also bought a knife for Dương to commit the crime.

At the end of the questioning, the representative of the High People's Procuracy in Ho Chi Minh City said that the defendants' statements were consistent with the results of the investigation and field experiment.

The application of legal provisions to the trial of the defendants was appropriate. The court of first instance's trial was well-founded and satisfactory.

The representative of the Procuracy requested the Appellate Court to reject all of the defendant’s appeals in the case and uphold the original judgment. In addition, the representative of the Procuracy also said that there was no basis to prosecute Ms. Tran Thi Trinh for criminal liability. Ms. Trinh did not know about Nguyen Hai Duong’s plot and plan, so there was no sign of the crime of “Failure to report a crime.”

According to the indictment of the People's Procuracy of Binh Phuoc province, because the victim's family did not approve of the love affair between Nguyen Hai Duong and Ms. Le Thi Anh Linh, Duong had the intention to kill and appropriate property.

On July 4, 2015, Duong invited Tran Dinh Thoai to Mr. My's house with the intention of killing someone and robbing his property. Thoai agreed, but because Du Minh Vy (14 years old, Mr. My's nephew), who was lured by Duong, did not open the door, the plan failed.

On the evening of July 5, 2015, Thoai bought a knife and gave it to Duong, but then said his grandmother was sick and could not go. On July 6, 2015, Duong asked Vu Van Tien to go rob property and Tien agreed.

At around 1am on July 7, 2015, Duong and Tien entered Mr. My’s house, killed all 6 people and stole property worth more than 49 million VND. On the evening of July 10, Duong and Tien were arrested. On August 9, 2015, Tran Dinh Thoai was temporarily detained.

On December 17, the People's Court of Binh Phuoc province held a first-instance trial of the case and sentenced defendant Nguyen Hai Duong and defendant Vu Van Tien to death for the crimes of "Murder" and "Robbery."

Defendant Tran Dinh Thoai was sentenced to 16 years in prison for the same crimes. In addition, the defendants must also compensate the victim’s family a total of 480 million VND.

The trial is scheduled to end on July 19.
