Strictly handle violations in the field of waterway traffic

The Government issued Decree No. 139/2021/ND-CP regulating administrative sanctions for violations in the field of inland waterway traffic. Notably, there is a provision for a fine of up to 75 million VND for the act of exploiting and using vessels beyond their service life.

Accordingly, this Decree imposes a fine of 1-2 million VND for the following acts: Not having a signboard as prescribed, applicable to tourist passenger vehicles; not having a vehicle registration certificate as prescribed; using a vehicle registration certificate that has been erased, deleted, modified or not issued by a competent authority as prescribed; not re-registering the vehicle as prescribed or not declaring to erase the vehicle name or declaring falsely to register the vehicle as prescribed.

Fines of up to 1 million VND for not equipping or not equipping enough life jackets or personal life-saving buoyancy devices as prescribed, the fine is calculated for each life jacket or personal life-saving buoyancy device.

For acts of not having a plan to ensure occupational safety and hygiene according to regulations; not having sufficient safety conditions for fire prevention and fighting or not having a fire fighting plan according to regulations, the fine is from 5 to 7 million VND.

Notably, the Decree clearly stipulates the fines for violations of the responsibilities of vehicle owners and vehicle renters. Vehicle owners who receive or use vehicles that do not meet operating conditions or do not have enough staff according to regulations; receive or use crew members working on vehicles without certificates of professional competence or professional certificates according to regulations shall be fined from 5-10 million VND.

Fines of 20-35 million VND apply to violations: Renting out vehicles that do not meet operating conditions as prescribed; subleasing vehicles and crew members on rented vehicles to others (except in cases where the vehicle owner agrees in writing); using rented vehicles as collateral.

The Decree stipulates that crew members and vehicle drivers on duty with alcohol concentration in their blood or breath will be fined up to 35 million VND...

This Decree takes effect from January 1, 2022; replacing Decree No. 132/2015/ND-CP dated December 25, 2015 of the Government regulating administrative sanctions for violations in the field of inland waterway traffic. For administrative violations in the field ofInland waterway transportIf an administrative violation occurs before the effective date of this Decree but is discovered later or a record of the administrative violation has been made, the penalty provisions under Decree No. 132/2015/ND-CP dated December 25, 2015 of the Government on penalties for administrative violations in the field of inland waterway traffic shall apply.
