To serve the construction of Vinh - Cua Lo road, Vinh City People's Committee has reclaimed 336/612.61m² Residential land has been granted a Land Use Rights Certificate since 2007 of the family of Mr. Nguyen Van Hoa and Mrs. Hoang Thi Lien (both grandparents have passed away).

At the time of declaring the current status and making a measurement to serve the land recovery work, on the land plot, two separate houses had been built, with separate land boundaries; one house was lived in by Mr. Nguyen Van Thai (son of Mr. Hoa and Ms. Lien) and the other house was lived in by the family of Ms. Dang Thi Xuan (daughter-in-law of Mr. Hoa and Ms. Lien) and Ms. Nguyen Thi Binh (daughter of Ms. Xuan) and her husband.

During the land use process, the family completed the procedures to request the division of the plot for Mr. Thai and Mrs. Xuan, but because the plot of land was in the planning for road expansion, it was not allowed to be divided. Mr. Thai's house is located entirely within the area to be recovered; Mrs. Xuan's house was affected and had to have the gate post and fence removed.

Regarding the area of ​​336 m² The land was recovered, Mr. Thai's family and co-heirs were compensated with a total amount of more than 2.76 billion VND; at the same time, considering the remaining area of ​​more than 276m2² enough to live, so Vinh City People's Committee did not consider resettling Mr. Thai's family.

After that, the family submitted a request for resettlement land allocation. The People's Committee of Vinh City and the Provincial People's Committee took action to consider it; thereby, considering that Mr. Thai's family was in a case of land reclamation, having to dismantle the housing construction on the reclamation land area, and at the same time, although the remaining land area was enough for residence, it belonged to the commercial and service land planning area, so the Provincial People's Committee assigned the Vinh City People's Committee to consider allocating a plot of land with land use fees collected in the project's resettlement planning area. Then, in December 2020, the People's Committee of Vinh City decided to allocate a plot of land with an area of ​​150m2² for Mr. Thai.

At the citizen reception session, Mr. Nguyen Ba Ngoc, hamlet 13, Nghi Phu commune, the person authorized by the family, requested to be assigned an additional resettlement plot for the co-heirs of Mr. Hoa and Ms. Lien, specifically to the family of his niece, Ms. Nguyen Thi Binh.

With this proposal, Vinh City People's Committee conducted a dialogue with the family and considered that Ms. Xuan's family has 3 children, of which 2 are working far away, and the youngest child, Ms. Nguyen Thi Binh, is married and living in her mother's house (Ms. Xuan), so they sent a document requesting the Provincial People's Committee to consider and agree in principle to allow Vinh City People's Committee to allocate an additional plot of land with land use fees outside the resettlement area to Mr. Thai's family and co-heirs.

At the citizen reception session, the leaders of the Department of Natural Resources and Environment and the Provincial People's Committee agreed with the proposed viewpoint of the Vinh City People's Committee. Speaking at the citizen reception session, based on the regulations, the Standing Vice Chairman of the Nghe An Provincial People's Committee, Le Hong Vinh, agreed with the viewpoint of allocating an additional plot of land with land use fees outside the resettlement area for the co-heirs to use the land, provided that the city has land funds to allocate. However, before allocating the additional plot of land, the city must re-determine the specific inheritance of Mr. Hoa and Ms. Lien.

However, at the citizen reception session, the family representative, Mr. Nguyen Ba Ngoc, did not agree with the plan to allocate an additional plot of land with land use fees outside the resettlement area, but reserved the view that an additional plot of land would be allocated in the resettlement area.

Speaking at the citizen reception session, Standing Deputy Secretary of the Provincial Party Committee Nguyen Van Thong emphasized: The key issue is to determine whether the co-heirs of Mr. Hoa and Ms. Lien were assigned 1 or 2 plots of land in the resettlement area, it is necessary to determine when the family applied for land division, whether they were eligible or not. Answering this question will thoroughly resolve the problem.

Concluding this content, Nghe An Provincial Party Secretary Thai Thanh Quy assigned the Provincial People's Committee to preside over the analysis and re-evaluation of the basis for allocating a plot of land with land use fees in the project's resettlement planning area with an area of ​​150 m2 to Mr. Thai; on that basis, answer the question of whether it is possible to allocate an additional plot of land with land use fees in the project's resettlement planning area as requested by the family or not? Because the nature of the case is that the families are living on a common plot of land that has not been divided into plots.

On that basis, report to have conclusion, agree on a plan to resolve the case thoroughly and strictly according to the provisions of law. This review and re-evaluation is carried out within 1 month from the date of receiving citizens.

Talking with Mr. Nguyen Ba Ngoc, the Provincial Party Secretary shared that, based on the citizens' petitions, the authorities will base on the regulations and practical process of site clearance for Vinh - Cua Lo road to resolve the issue in a reasonable manner, ensuring fairness and the interests of citizens when implementing the province's policy.
