What additional powers do traffic police have from August 1?

Traffic police are allowed to use the results and images provided by organizations to determine the basis for penalizing violators.

Decree 46/2016 of the Government regulating administrative sanctions for violations in the field of road and railway traffic, effective from August 1, has added a provision allowing traffic police to "sUse results obtained from technical equipment and means provided by organizations assigned to manage, exploit and maintain road and railway traffic infrastructure as a basis to determine administrative violations and sanction administrative violations in the field of road and railway traffic.

This means that traffic police will have more authority to verify information and images provided by the above organizations as a basis for handling traffic violations.

However, the Decree clearly states,The use of means and equipment must be inspected, calibrated, tested, and must comply with the principles stipulated in the Law on Handling of Administrative Violations. That is, respecting the freedom, honor, dignity, privacy of citizens, other legitimate rights and interests of individuals and organizations; complying with procedures and rules on the use of professional technical means and equipment.

For users of technical equipment and vehicles to record images, the following criteria must be met: being employees of organizations assigned to manage, exploit, and maintain road and railway traffic infrastructure; being trained in the operating procedures, use, and preservation of technical equipment and vehicles, and relevant legal regulations on handling administrative violations.

Decree 46 allows ministriesThe Chief of Police and the Chief of Transport, based on their assigned functions and tasks, shall issue documents regulating the procedures for using professional technical equipment and vehicles for subjects under their management; inspect and handle violations in the management and use of prescribed professional technical equipment and vehicles.
