Homeowner sentenced to prison for allowing guests to gamble at home after drinking party

On the afternoon of March 4, 2021, Tan Ky District People's Court tried the criminal case against Nguyen Van Trung, Dao Cong Ca, Nguyen Trong Phu and Hoang Thi Oanh for gambling.

At about 11:00 a.m. on December 17, 2020, Nguyen Dinh An, born in 1970, residing in Tan Hoa hamlet, Nghia Hanh commune (Tan Ky) invited subjects in Tan Ky district, namely Nguyen Van Trung (born in 1986, residing in Dong Huong hamlet, Tan Huong commune); Dao Cong Ca (born in 1993, residing in Nguyen Trai hamlet, Nghia Hanh commune) and Nguyen Trong Phu (born in 1986, residing in Ky Nam hamlet, Ky Son commune) to his house to play and drink alcohol.

At about 1:30 p.m. the same day, Nguyen Dinh An went to bed to sleep, An's wife, Hoang Thi Oanh (born in 1973), came to clean up the tray. At about 2:30 p.m. the same day, while the subjects were gambling with each other, the Nghia Hanh Commune Police task force raided and caught them red-handed, confiscating 15.6 million VND and the items they used for gambling. While the police force was working, Nguyen Trong Phu fled the scene. On December 23, 2020, Nguyen Trong Phu turned himself in to the Tan Ky District Police Investigation Agency, confessing all his crimes.

The three people involved in gambling have all been in and out of prison, of which Trung was sentenced by the People's Court of Nghe An province to 7 years in prison for child rape; Ca was sentenced by the People's Court of Con Cuong district to 9 months in prison, suspended, for theft; Phu was imprisoned twice (28 months in prison for intentional injury and 7 years in prison for theft). All of their criminal records have been cleared.

Hoang Thi Oanh, although not directly participating in gambling and not collecting "pool" money, agreed to let the above subjects gamble at the location under her management. Therefore, Ms. Oanh's behavior was an accomplice to the crime of gambling.

As for Mr. Nguyen Dinh An, he is the person who has the right to manage the location where the subjects used to gamble, but during the gambling process, Mr. An was drunk and went to bed, so he is not criminally responsible.

At the end of the trial, the panel sentenced: Ca to 9 months in prison, Trung to 9 months suspended sentence, Phu to 12 months of non-custodial reform, and Oanh to 6 months of non-custodial reform.
