Comrade Nguyen Duc Trung - Chairman of the Provincial People's Committee received Ms. Tran Thi Lieu (representing employees at Investment - Construction and Trade Joint Stock Company 423 - abbreviated as Company 423) to propose to resolve the salary and social insurance benefits of employees at the Company.

According to the provincial Social Insurance leader, as of June 2021, the number of employees working at Company 423 was 22, with 85 employees owing 16 months of salary with an amount of more than VND 2,417 billion. As of May 2021, 136 employees of the Company had quit their jobs but had not yet had their Social Insurance books confirmed, and the Company currently owes VND 9,529 billion in Social Insurance, including principal and late payment interest.

The Department of Labor, Invalids and Social Affairs, the Provincial Social Insurance, and the Economic Police Department of the Provincial Police have taken many measures to request Company 423 to strictly comply with its obligations to pay social insurance, unemployment insurance, and health insurance for its employees, but so far there have been no results. The Provincial Social Insurance proposed to give the Company a 3-month period to find a source to pay salaries and social insurance debts for employees. If the time limit is exceeded, the Provincial Police will investigate and handle the case according to regulations.

Mr. Nguyen Van Hung - Director of Company 423 said that because the Company is operating at a loss, it has no money to pay social insurance and salaries to employees. In addition, the Company currently has many projects but has not been paid yet.

The Director of Company 423 also affirmed that he will focus on debt collection and advance profits from upcoming projects to pay social insurance for employees. From now until the end of 2021, he will pay about 4 billion VND. By 2022, he will pay an additional 2 billion VND and by 2023, he will completely resolve the social insurance debt.

After reviewing the entire case, the Chairman of the Provincial People's Committee assessed that the petition of the employees at Company 423 was legitimate and in accordance with the law and this was the obligation of the enterprise. The Provincial People's Committee also issued a decision on administrative sanctions, the sectors have intervened and taken many measures but up to now the enterprise has not implemented them.

Based on the opinions of Company 423 and the sectors, with the view of protecting the rights of workers, Chairman of the Provincial People's Committee Nguyen Duc Trung assigned the Provincial Social Insurance to preside over and coordinate with the Department of Labor, Invalids and Social Affairs, the Provincial Police, and the Provincial Labor Federation to establish a working group to review the entire case accurately and completely. However, it is also necessary to consider creating conditions for businesses to have time to pay their debts.

In addition, businesses must also make efforts to prioritize the arrangement of social insurance contributions, first of all, the principal debt for retirees and those in difficult circumstances. The results of the settlement must be reported to the Chairman of the Provincial People's Committee before July 30, 2021. In particular, clarify the commitment of businesses on the roadmap for debt repayment obligations, and closely supervise the implementation by the sectors. Consider and resolve the recommendations of businesses in accordance with legal regulations.

Next, Chairman of the Provincial People's Committee Nguyen Duc Trung received citizen Tran Van Hoai (house number 128, Nguyen Xuan Linh street, Vinh city). Mr. Hoai reported that the Vinh City People's Committee and the Department of Natural Resources and Environment did not complete the procedures to re-grant the garden land area into residential land for his family.

Chairman of Vinh City People's Committee Tran Ngoc Tu affirmed that after reviewing the documents, it was found that the government's land allocation to Mr. Hoai was completely in accordance with the Land Law and Decision 16/2018 of the Provincial People's Committee. Although Vinh City has explained many times, citizens still do not agree, so citizens have the right to file a lawsuit in court to resolve the matter according to regulations.

Mr. Hoang Quoc Viet - Director of the Department of Natural Resources and Environment explained the application of Decision No. 16/2018 of the Provincial People's Committee on determining the residential land limit for residential land plots with gardens and ponds formed before December 18, 1980 and affirmed that the implementation of this decision according to the 2013 Land Law is beneficial to the people.

After listening to the opinions of the sectors and the Vinh City People's Committee, Chairman of the Provincial People's Committee Nguyen Duc Trung affirmed that citizens' complaints and reflections are rights stipulated by law. And state agencies also base on legal regulations to resolve citizens' petitions.

The Chairman of the Provincial People's Committee assigned Dong Vinh Ward (Vinh City) to continue explaining legal regulations to citizens, guiding citizens to negotiate with land sellers to resolve the matter, ensuring legitimate rights for the people. If citizens do not agree with the decisions of state agencies, they have the right to file a lawsuit in court to be resolved according to regulations./.
