Prime Minister's dispatch on implementing amnesty work in 2022

Permanent Deputy Prime Minister Pham Binh Minh signed Official Dispatch No. 634/CD-TTg dated July 21, 2022 of the Prime Minister on implementing amnesty work in 2022.

On July 4, 2022, the Amnesty Advisory Council issued Instruction No. 73/HD-HDTVDX on the implementation of Decision No. 766/2022/QD-CTN dated July 1, 2022 of the President on amnesty in 2022. In order to seriously and effectively implement amnesty work in 2022, well implement the humane and lenient policies and guidelines of the Party and State towards criminals and contribute to effectively implementing the Resolutions, Directives, Programs and Plans of the Central, National Assembly and Government on crime prevention and control to achieve results, the Prime Minister requests:

1. The Ministry of Public Security shall perform well its advisory and standing functions for the Amnesty Advisory Council; be directly responsible for directing the consideration of amnesty proposals for prisoners serving sentences in prisons, temporary detention camps, and temporary detention centers managed by the Ministry of Public Security; urge, guide, and inspect ministries, branches, and localities in implementing the amnesty; promptly remove difficulties and obstacles that arise; and report to the Chairman of the Amnesty Advisory Council for consideration and decision in cases beyond its authority.

2. The Ministry of National Defense is directly responsible for closely directing the consideration of amnesty requests for prisoners serving sentences in prisons and detention camps managed by the Ministry of National Defense.

3. Propose that the Supreme People's Court directly direct and guide People's Courts and Military Courts at all levels to preside over the consideration of amnesty requests for people whose prison sentences are being postponed or temporarily suspended.

4. The Ministry of Information and Communications directs news agencies and newspapers to fully report on the contents of documents on amnesty in 2022 so that all people and prisoners clearly understand the conditions, standards, processes and procedures for considering amnesty... so that they can protect their own legitimate rights and interests, compare and monitor the activities of competent authorities, avoid confusion and errors; at the same time, contribute to raising awareness and responsibility of all levels, sectors, social organizations and the masses to eliminate inferiority complex towards amnesty recipients and pay attention to creating conditions to help them integrate into the community.

5. The ministries, branches and agencies mentioned in the Guidelines of the Advisory Council for Special Amnesty have specific plans to implement assigned tasks; organize dissemination, dissemination and ensure that special amnesty work is carried out in a unified, safe, public and transparent manner, following strict procedures, for the right subjects and under the conditions prescribed by law; ensuring the legitimate rights and interests of prisoners, absolutely not allowing negativity or errors to occur.

6. The Chairmen of the People's Committees of provinces and centrally run cities shall direct the branches and People's Committees at all levels to coordinate with the Fatherland Front and mass organizations to strictly implement Decision No. 766/2022/QD-CTN dated July 1, 2022 on amnesty in 2022 of the President and Instruction No. 73/HD-HDTVĐX dated July 4, 2022 of the Amnesty Advisory Council. Specifically:

a) Direct the Department of Information and Communications to closely coordinate with the Provincial Party Committee's Propaganda Department, City Party Committee, and local press agencies to widely propagate amnesty work on mass media.

b) Direct the Departments of Justice, Labor - Invalids and Social Affairs, Health and People's Committees at all levels, within the scope of their functions and duties, to provide full information, documents, certificates, confirmations and other necessary documents related to the person proposed for amnesty.

c) Directing authorities at all levels to coordinate with the Fatherland Front, agencies, economic organizations, unions, and social organizations in the locality to actively and effectively implement Decree No. 49/2020/ND-CP dated April 17, 2020 of the Government detailing the implementation of the Law on Enforcement of Criminal Judgments on community reintegration. Continue to monitor, manage, educate, assist, provide vocational training, and create jobs for pardoned people returning to the community to eliminate inferiority complexes, do honest work, and limit recidivism and violations of the law. For pardoned people in especially difficult circumstances, mobilize sectors, unions, and socio-economic organizations to pay attention and help them borrow capital to do business, stabilize their lives, and integrate into the community.

d) Direct the Director of the Provincial Police to coordinate with local departments, branches, unions and social organizations to effectively manage, educate and assist amnestied people; grasp the situation and developments of amnestied people residing in the locality, not allowing them to affect national security and social order and safety, and promptly and strictly handle those who re-offend and violate the law.

7. The Ministry of Public Security (Standing Agency of the Amnesty Advisory Council) is responsible for monitoring, synthesizing and reporting implementation results to the Prime Minister and the Amnesty Advisory Council./.
