National Assembly member regrets that crime of buying and selling positions is not included in Criminal Code
National Assembly Delegate Do Van Duong expressed regret that the crime of buying and selling positions of power was not included in the Criminal Code.
Commenting on the work of the Prime Minister and the Government in the last term, delegate Truong Trong Nghia (Ho Chi Minh City National Assembly Delegation) said that with flexible management, the Government in the last term has maintained comprehensive socio-economic stability, helped the country overcome the crisis, maintained positive growth, and at the same time had a resolute attitude towards China's violation of sovereignty.
In particular, the Government has had a spirit of institutional innovation, paid more attention to law-making and protecting human rights... these results have been recognized by voters.

"If only the Prime Minister would discipline a few cases soon"
However, the delegate said that if the Government continues to operate in the old way, it will inevitably fall into the middle-income trap. Meanwhile, corruption is still serious, violating the rights of honest people, weakening the country's resources, and depleting national resources, which have not been reduced during the past term. Illegal activities are becoming more and more brazen and public.
“Of course the responsibility lies with the entire political system, but the Government played a leading role in the last term. Voters believe that if the Prime Minister had disciplined a few cases sooner, the situation would have improved. We shouldn’t have waited until things went wrong for them to go to court,” said delegate Nghia.
Therefore, voters suggest that the upcoming Government needs to reform its management methods. The Prime Minister needs to boldly discipline, even replace ministers, chairmen and vice chairmen of provincial People's Committees who commit violations or fail to complete their tasks without waiting for the end of their term. Put an end to the situation where superiors give orders and subordinates ignore.
Commenting on the current mechanisms and institutions that are still entangled with many relationships, delegate Do Van Duong (Ho Chi Minh City National Assembly Delegation) pointed out that the limitations in the past term had many causes, but the Government cannot be blamed entirely.
Currently, in the state apparatus, including mass organizations operating on the state budget, the state budget is not decreasing but increasing. According to estimates, salary expenditures each year are nearly 400,000 billion VND/year, if fully spent, it would be about 1 million billion VND, equal to the country's entire annual budget.
“That means if we eat it all up, where will we get the money to invest in development? There is a problem here due to the Law on Organization of State Administrative Agencies. The Law on Organization of Local Government alone increases the number of positions in People’s Councils at all levels by 22,000, so the goal of reducing positions will be impossible to achieve,” said Delegate Duong.
Notably, according to delegate Do Van Duong, in the process of organizing the implementation of the National Assembly resolution, according to the annual reports of ministries and branches, only 1% of cadres failed to complete their tasks. Meanwhile, public opinion is buzzing about 1/3 of cadres failing to do their jobs, "going to work with an umbrella in the morning and returning home with an umbrella in the evening".
Therefore, the important solution is to cut down the organizational apparatus, unify some positions between the Party and the government such as district chief, provincial chief so that words go hand in hand with actions, avoid saying one thing and doing another, not fear power being concentrated in one person but only fear that words do not go hand in hand with actions and fear responsibility.
"Running for office is creating great injustice"
The delegate also said that we should reduce the number of mass organizations, especially mass organizations operating on the state budget, by legalizing similar organizations to reduce intermediary cadres and movement cadres who have to directly produce products, limiting dependence and parasitism on the state.
“Public opinion is buzzing about the situation of buying and selling positions and that is true and why do people like to buy and why can they buy? This is a very big question that voters have said has never been answered in many past terms. This buying and selling of positions is creating great injustice,” delegate Duong pointed out.
From the above reality, the delegate proposed that the political system should look at and re-evaluate whether or not there is any buying and selling of positions and power. This not only creates great injustice but also creates social evils because those who have bought and sold positions and power will continue to rake in profits, "collecting to cover expenses".
Although it is considered a "sensitive and complex issue", according to delegate Do Van Duong, this still needs to be done because running for office is dangerous to the survival of the generation, a body with many viruses that invade the government without a cure is not acceptable. Many resolutions have been issued on this issue, but sometimes talking too much stimulates the virus to develop, that is the danger.
“Only the Politburo can answer this question and make decisions to attack it like attacking a criminal. I regret that the crime of buying and selling official positions is not included in the Criminal Code, it must be considered a criminal offense. Now we can only wait for the highest leadership. Voters say that you talk too much but if you don’t change the situation, you should stop talking,” delegate Duong stated./.
