Proposal to expand the composition of the Valuation Council in the Land Law (amended)

The draft Land Law (amended) consists of 245 articles and 16 chapters. Amending the Law is necessary because the current land management and use still has many limitations in a number of aspects such as: Land use planning has not ensured consistency, comprehensiveness, systematization, low quality, lack of long-term vision, has not met the requirements of sustainable development, and has not been strictly implemented; access to land by organizations and individuals, especially ethnic minorities through land allocation and land lease, is still inadequate; administrative reform in land management has not met practical requirements; complaints, denunciations, and violations of land law are still numerous but handling is still limited...
At the conference, the delegates assessed that the Land Law is an important and complex law, affecting all aspects of the country's socio-economic life, national defense, security, and environmental protection. Therefore, the revised Law needs to ensure consistency, stability, and inheritance of the land law system; develop regulations that have been proven correct in practice and operate smoothly.

Commenting on the amendment of the Land Law, the representative of the Department of Natural Resources and Environment said that there is a big difference between the land price list and the actual price. Therefore, it is necessary to perfect the mechanism for determining land prices according to market principles, and the inspection and supervision mechanisms of the Central Government and the People's Council in the construction of the land price list.
Opinions suggest that forestry land should be separated from agricultural land for different purposes. In addition, it is necessary to improve the mechanism and policies on management and use of agricultural land in the direction of expanding the subjects and limits of receiving the right to transfer agricultural land use, regulations for agricultural land users to change purposes, and improve the efficiency of agricultural land use according to planning.
Regarding the role of the Fatherland Front, the representative of the provincial Fatherland Front said that in the current draft, it is stipulated that only when land is forcibly recovered and people do not agree, does the Front need to get involved. However, it is necessary to stipulate that the Front must get involved right from the step of announcing land recovery and approving compensation plans. In addition to advocacy and persuasion, the Front needs to have a critical voice from the time of project development.

In addition, opinions also contributed to a number of issues such as: Supplementing the rights and obligations of citizens regarding land, including the right to participate in state management of land, the right to complain and denounce land in specific cases. Proposing to promote administrative procedure reform; shifting the focus from management by administrative tools to effective use of economic tools to promote rational, effective and sustainable land use; expanding the composition of the Land Valuation Council; supplementing the procedures for developing land price lists...
At the conference, experts and managers contributed opinions on shortcomings and limitations and made many recommendations to amend the Land Law. Based on the opinions of the delegates, the Provincial National Assembly Delegation will synthesize and submit to competent authorities to perfect the land law and policy.
