Adjusting the salary level to pay 3 types of insurance for employees

(Baonghean) - Nghe An Provincial Social Insurance has just issued Official Dispatch No. 802/BHXH-QLT dated May 26, 2017 on adjusting the salary level for social insurance, health insurance, and unemployment insurance contributions for employees to the Heads of labor-using units in the area.

On February 10, 2017, Nghe An Social Insurance issued Official Letter No. 157/BHXH-QLT on the announcement of the regional minimum wage in 2017 to the Heads of labor-using units, and at the same time requested the units to apply the salary level in accordance with regulations to implement social insurance, health insurance, unemployment insurance for employees. However, through reviewing the data on labor management participating in social insurance, health insurance, unemployment insurance in Nghe An province, as of May 24, 2017, there were still a number of employees whose salary for social insurance, health insurance, unemployment insurance was lower than the regional minimum wage prescribed in Decree No. 153/2016/ND-CP of the Government, affecting the payment of social insurance, health insurance, unemployment insurance for employees.

To ensure the rights of participants, Nghe An Social Insurance respectfully requests the Head of the unit to continue to pay attention to implementing the social insurance, health insurance and unemployment insurance policies for employees; at the same time, adjust the salary level for social insurance, health insurance and unemployment insurance contributions in accordance with the provisions of law.

Specifically:

1. The salary stated in the contract and paid to employees working in normal working conditions and the simplest work:

- The level of 2,900,000 VND/month/person applies to businesses operating in Vinh city (Region III);

- The level of VND 2,580,000/month/person applies to businesses operating in districts and towns of Nghe An province (region IV).

2. For employees doing jobs that require vocational training as prescribed in Clause 2, Article 5 of Decree No. 153/2016/ND-CP dated November 14, 2016, the salary stated in the labor contract must be at least 7% higher than the regional minimum wage.

Employees doing jobs or positions with arduous, toxic, or dangerous working conditions must have their salaries at least 5% higher; employees doing jobs or positions with especially arduous, toxic, or dangerous working conditions must have their salaries at least 7% higher than the salaries of jobs or positions of equivalent complexity, working under normal working conditions.

3. Enterprises operating in a locality shall apply the regional minimum wage prescribed in that locality. In case an enterprise has branches operating in localities with different regional minimum wages, the unit or branch operating in which locality shall apply the regional minimum wage according to that locality. For enterprises operating in industrial parks, export processing zones, and high-tech zones located in localities with different regional minimum wages, the locality with the highest regional minimum wage shall apply.

4. In case after 6 months from the effective date of Decree No. 153/2016/ND-CP of the Government (January 1, 2017), the unit adjusts the salary level for social insurance, health insurance, unemployment insurance for employees, in addition to the amount payable according to regulations, the unit must also pay interest on the amount payable.

Nghe An Provincial Social Insurance informs the Heads of units to know and coordinate with the Social Insurance agency to promptly implement the policies of Social Insurance, Health Insurance, and Unemployment Insurance for employees.
