Conditions and procedures for exporting minerals abroad
The Ministry of Industry and Trade is drafting a Circular regulating the export of minerals. It clearly states the conditions and procedures for exporting minerals.

1- Established and operating under the provisions of the Enterprise Law, meeting the conditions prescribed by the Commercial Law on export, import, processing and agency activities for buying and selling goods with foreign countries.
2- Not being concluded by a competent state agency to have violated the law on minerals, environmental protection, mineral export or having a notice of temporary suspension of mineral export.
Minerals are allowed to be exported when they simultaneously meet the following conditions: They have been processed to meet prescribed quality standards and are listed in the List of Exported Minerals; and have legal origin.
The draft clearly states that for minerals containing thorium and uranium equal to or greater than 0.05% by weight, when exporting, in addition to ensuring the above conditions, a license to export radioactive materials from the Ministry of Science and Technology must be obtained according to the provisions of the Law on Atomic Energy.
According to the draft, when carrying out procedures for exporting minerals, in addition to complying with Customs regulations, enterprises must also present the original and provide certified copies of the following documents to the Customs authority: Quality declaration or Standard and quality analysis certificate of each batch of exported minerals. Documents proving the legal origin of exported minerals.
In addition, enterprises must also provide mineral export reports of the previous period (Reports sent to management agencies as prescribed), except for enterprises that have just exported in the first reporting period.
The draft clearly states that before carrying out customs clearance procedures, the border customs office and the enterprise will take samples to test the quality of each export shipment as a basis for settlement. The quality analysis samples will be conducted by a VILAS-certified laboratory, and the cost of sample analysis will be borne by the enterprise. In case the results of the export shipment inspection are inconsistent with the enterprise's declaration, the border customs office will notify the provincial People's Committee and the Ministry of Industry and Trade for coordination in handling.
Enterprises violating mineral quality declaration will be handled according to current regulations and will not be allowed to continue exporting minerals until they receive approval from the Ministry of Industry and Trade.
