Identifying the work of law-making as a key task to contribute to the National Assembly's institutionalization of the Party and State's guidelines, accordingly, based on the National Assembly's 2020 Law-making Program, the Provincial National Assembly Delegation has organized many forms of collecting opinions on draft laws passed and commented on at the 9th and 10th sessions.XIV National Assembly.

In 2020, due to the work of prevention and controlCovid-19 epidemicThe provincial National Assembly Delegation has conducted various forms of soliciting opinions on draft laws such as: soliciting opinions in writing, assigning articles to experts, leaders of some departments and branches, and organizing seminars. The provincial National Assembly Delegation has also organized soliciting opinions on 21 draft laws, of which 13 draft laws were passed and 8 draft laws were commented on in various forms.

The law-making work is carried out by the Delegation on the basis of strengthening coordination with leaders of functional departments, branches and sectors; the consultation focuses more on the groups of subjects subject to the regulation of draft laws for specialized draft laws... Along with that, sending documents to solicit opinions from departments, branches and localities in the province on difficulties and shortcomings in the implementation of current legal policies. Thereby, researching, synthesizing and sending to the Standing Committee of the National Assembly, the Government, relevant ministries and branches to propose amendments and supplements suitable to reality.

Through comments on the draft law,Provincial National Assembly Delegationhas reported the synthesis of comments on law-making to the National Assembly Standing Committee as prescribed. In addition, the Provincial National Assembly Delegation has actively advised on improving and innovating the activities of the legal development collaborators, selecting experts with in-depth expertise in the fields of justice, socio-economics and practical experience to contribute comments on the contents discussed at the National Assembly session. Along with studying and participating in draft laws at the Delegation, National Assembly Deputies who are members of the National Assembly Committees have attended plenary sessions of the Committees, conferences and seminars organized by the National Assembly Committees to examine draft laws submitted at the session.

Lively and responsible discussion

At the discussion sessions, delegates in the provincial National Assembly Delegation frankly gave comments to the drafting committee on the shortcomings and inadequacies in the law-making work as well as assessed the impact of the law amendment on society.

For example, at the recent 10th session, voters in the province continued to witness the enthusiastic, dedicated and responsible participation of the provincial National Assembly deputies in the session's contents, voting to decide on many important issues of the country.Provincial National Assembly Delegationparticipated in online discussions and discussions in the hall to contribute opinions to the draft Laws.

Specifically, regarding the opinions related to the authority to appraise environmental impact assessment reports in Clause 3, Article 36 of the Law on Environmental Protection (amended), the National Assembly Delegation of Nghe An provincechoose option 2and believes that this option is reasonable, not assigning additional appraisal expertise to the construction management departments (investors), but in the appraisal process there is participation and coordination of the construction management department. The provincial National Assembly delegation expressed agreement on adding the content of "environmental audit".

Regarding the content of the Law on Residence (amended), the Provincial Delegation of National Assembly Deputies proposed to supplement the content on the conditions for temporary residence registration in cases where the temporary residence registrant is under 18 years old, requiring the opinion of a guardian or a document proving the family relationship between the head of household and the temporary residence registrant. At the same time, it is recommended to consider the regulation on the cancellation of this permanent residence registration to limit the cases of Vietnamese citizens sentenced to a fixed-term prison term after completing their sentence and reintegrating into the community without a permanent residence.

Participating in the discussion of the draft Law on Vietnamese Workers Working Abroad under Contract (amended), the Provincial Delegation of National Assembly Deputies said that the law needs to have strict regulations on responsibilities as well as maximum protection of the rights of Vietnamese workers working abroad. At the same time, the discussion opinions of the delegates in the Delegation reflected and clarified that there are still many shortcomings and lack of synchronization and unity in the draft Law. The opinions of the Provincial Delegation of National Assembly Deputies have made practical contributions to the laws related to important issues of the country's socio-economy, national defense - security, and foreign affairs as well as perfecting the draft laws and resolutions before their adoption.

Before the session, the Delegation collected opinions from relevant organizations and individuals on the draft laws. The Provincial Delegation of National Assembly Deputies also assigned National Assembly Deputies in the delegation to conduct in-depth research to have quality opinions on the draft laws submitted at the National Assembly sessions. After the National Assembly sessions, the Provincial Delegation of National Assembly Deputies has focused on carrying out propaganda and dissemination of laws so that the Laws promulgated by the National Assembly can soon come into life.
