Comments on the draft Law amending and supplementing a number of articles of the Law on Intellectual Property

At the conference, delegates agreed to consider and pass the Law amending and supplementing a number of articles of the Law.Intellectual Property Law,to ensure the unity of the legal system, synchronization and feasibility.

The completed Intellectual Property Law will encourage and motivate creativity, promote the efforts and contributions of many individuals in technical innovation and scientific research activities to create material and spiritual products for society as well as protect the rights and legitimate interests of intellectual property rights holders and prevent and stop acts of intellectual property rights infringement.

Accordingly, many opinions focused on discussing and clarifying the responsibilities of intermediary entities on the internet in the field of copyright and related rights in Vietnam; amending and supplementing regulations on the mechanism and benefit sharing ratio for inventions, industrial designs, and layout designs as scientific and technological tasks using the state budget is very necessary, resolving practical shortcomings related to this issue; plans to adjust the provisions of the draft Law on famous trademarks; provisions of international treaties on copyright exceptions and experiences for Vietnam...

Dr. Dinh Van Liem - Dean of the Faculty of Law, Vinh University, said that in Article 25, the exceptions do not infringe upon copyright. This delegate said that he did not agree with part of the content of this provision in the draft. This content will seriously affect the rights such as the right to publish, the right to copy the owner's work, especially for scientific works, specifically textbooks, teaching materials, monographs, reference books, etc.

Because, the users of scientific works in general are mainly researchers, lecturers and students. Therefore, allowing scientific researchers and students to copy even one copy of a work and not for commercial purposes will also greatly affect intellectual property rights holders. With this provision, it is possible that authors and intellectual property rights holders will not be able to ensure compensation for creative activities, which will not encourage creativity - the important meaning of copyright protection. Compared to the average income of Vietnamese people today, the amount of money to pay to buy a book is not high. Currently, the situation of pirated books is very common, photocopying places are springing up everywhere to print documents, so how is copyright protected?

In addition, many opinions say that it is necessary to amend current legal regulations on pricing new varieties and plants, because they still cause difficulties and are not suitable for reality, leading to the current prices of new varieties and plants often being lower than their actual value...
