The delegation of National Assembly representatives from Nghe An province is gathering feedback on the draft Law on Organization of Local Government (amended).
On the morning of April 28, the National Assembly delegation of Nghe An province held a conference to gather feedback on the draft Law on Organization of Local Government (amended) and the Law amending and supplementing a number of articles of the Law on promulgation of legal normative documents.
Comrade Tran Nhat Minh - Member of the National Assembly's Law and Justice Committee, and full-time National Assembly representative - chaired the conference.

The Law on Organization of Local Government (amended) consists of 7 chapters and 54 articles. This is a draft amendment aimed at implementing the policy of a two-tiered government model, improving the quality, efficiency, effectiveness, and effectiveness of operations.
In providing feedback, representatives from provincial and district-level agencies and units generally agreed with the draft Law on Organization of Local Government (amended), based on inheriting and developing the principles of administrative organization towards decentralization and delegation of power, and promoting the autonomy and responsibility of local governments. The draft law also complies with regulations on the form of law promulgation and has a reasonable and scientific structure.

The delegates also contributed many suggestions, including the need for concise and clear regulations on the organization and operation of local governments, such as adherence to the Constitution and laws; ensuring professionalism, modernity, and efficiency; and focusing on democratic centralism and promoting the people's right to self-governance.

At the same time, the draft law needs to clearly define and distinguish the division of powers, decentralization, and delegation of authority between different levels, enhancing the proactive role of local governments; clearly linking the authority of the central government and the two levels of local government, avoiding overlapping responsibilities, gaps in duties and powers, or shirking responsibility, waiting for opinions, and a "request-and-grant" system.

The delegates also analyzed and offered in-depth comments on the authority and responsibilities of the People's Councils and People's Committees at the provincial and commune levels; the authority and responsibilities of the chairmen of the People's Committees at the provincial and city levels; clarified concepts to ensure transparency; and suggested adding a separate law on "commune-level special zones" with specific criteria or changing the name to avoid duplication of concepts.

Some opinions suggested that the draft Law should stipulate that the head of the commune People's Council must be a full-time professional, in order to increase the effectiveness of the commune-level People's Council. Some delegates also had differing opinions regarding the regulations on the authority and responsibilities of the commune-level People's Council, and whether or not it should be allowed to approve local land use plans and schemes…

Regarding the Law amending and supplementing a number of articles of the Law on the promulgation of legal normative documents; in addition to basically agreeing with the content of the draft, some delegates also suggested that the criteria and conditions for issuing abbreviated documents in cases of natural disasters, fires, and urgent security and defense matters should be clearly defined; at the same time, some provisions should be reviewed to ensure consistency with related laws and regulations; and the wording should be revised to be concise and clear, making it easier to implement in practice.

Based on the opinions of the participating delegates, Comrade Tran Nhat Minh - Member of the National Assembly's Law and Justice Committee, and full-time National Assembly delegate - acknowledged and affirmed that the suggestions would be fully compiled and sent to each National Assembly delegate in the provincial delegation for study and submission to the National Assembly session.

Comrade Tran Nhat Minh also expressed his wish that the agencies and delegates continue to study and provide further feedback to the Office of the National Assembly Delegation and the Provincial People's Council for compilation.
