Inspect the Project of Vietnam-Laos Economic Cooperation Corporation in Vinh city within 30 days

Decision No. 2673/QD-UBND was issued by the Provincial People's Committee on September 7, 2022. The interdisciplinary inspection team includes members from the Department of Natural Resources and Environment, Department of Planning and Investment, Department of Finance, Department of Construction, Department of Justice and Vinh City People's Committee. Mr. Pham Van Toan - Deputy Director of the Department of Natural Resources and Environment was assigned by the Provincial People's Committee to be the Head of the team.

The interdisciplinary inspection team has the following tasks:

Inspect the compliance with the law on land, investment, construction, real estate business, housing and related laws in the implementation of the Project of Commercial Service Area, Office for Lease, High-rise Apartment Building in Hung Dung Ward, Vinh City for the Vietnam-Laos Economic Cooperation Corporation and organizations and individuals receiving the transfer of land use rights of the Vietnam-Laos Economic Cooperation Corporation.

Check and review the procedural documents of state management agencies for the Project of Commercial Service Area, Office for Lease, High-rise Apartment in Hung Dung Ward, Vinh City.

Synthesize and report inspection and review results; advise the Provincial People's Committee to handle in accordance with legal regulations.

Regarding authority, the Inspection Team has the right to work with relevant organizations and individuals according to the provisions of law.

Decision No. 2673/QD-UBND also clearly states the rights, obligations and responsibilities of the inspected subjects as follows:

Relevant organizations and individuals are responsible for providing complete and timely records and documents related to the Project of Commercial Service Area, Office for Lease, High-rise Apartment Building in Hung Dung Ward, Vinh City; fully explaining issues related to the Project as requested by the Inspection Team.

The rights and obligations of the inspected unit shall be implemented in accordance with current law provisions.

The inspection period of the Interdisciplinary Inspection Team is 30 working days from the date of announcement of the Inspection Decision (excluding holidays as prescribed by the State).

The project of commercial service area, office for lease, high-rise apartment building in Hung Dung ward, Vinh city was granted an Investment Certificate and approved for detailed construction planning at a scale of 1/500 by the Provincial People's Committee in 2010; since then, it has been inspected 3 times by inspection teams established by the Provincial People's Committee in 2013, 2016 and 2021.

On April 20, 2022, the Provincial People's Committee issued Official Dispatch No. 2790/UBND-CN assigning the Department of Natural Resources and Environment to preside over and coordinate with relevant departments, branches, sectors and localities to review records and procedures for granting land use right certificates and land transfer for the project of Commercial Service Area, Office for Lease, High-rise Apartment Building in Hung Dung Ward, Vinh City, invested by the Vietnam-Laos Economic Cooperation Corporation.

On August 5, 2022, the Department of Natural Resources and Environment issued Official Dispatch No. 4627/STNMTQLDD requesting the Provincial People's Committee to establish an Interdisciplinary Inspection Team to comprehensively inspect and review the project of Commercial Service Area, Office for Lease, High-rise Apartment Building in Hung Dung Ward invested by the Vietnam-Laos Economic Cooperation Corporation. The reason is that the Departments, branches and Vinh City People's Committee have different opinions on handling previous violations of the law by the investor, on land division, granting of land use right certificates, transfer of land use rights and proposed plan to handle the Project of Commercial Service Area, Office for Lease, High-rise Apartment Building in Hung Dung Ward. In addition, this project was granted an Investment Certificate by the Provincial People's Committee in 2010, and up to now, the investor has transferred the land use rights to other land users; Reviewing the proposed contents of the Project involves the responsibilities of many departments, branches, and Vinh City People's Committee.

Regarding the Project of Commercial Service Area, Office for Lease, High-rise Apartment Building in Hung Dung Ward, Vinh City, on April 1, 2022, the Supervision Delegation of the Provincial People's Council also organized a field inspection of the implementation of this project; thereby recording the following information: the project was approved by the Provincial People's Committee for detailed construction planning at a scale of 1/500 and granted a Certificate of Land Use Rights in 2010 with a total assigned field area of ​​4,056 m²In 2018, the Provincial People's Committee allowed the investor to transfer land use rights for this project.
