(Baonghean.vn) - In the face of measures to tighten management of real estate business activities and especially Decree No. 16/2022/ND-CP of the Government on administrative sanctions in the construction sector, many people in Nghe An have registered to apply for practice certificates.

According to the representative of the Real Estate Management Department, Department of Construction, Nghe An currently has about 300 - 400 people who have been granted consulting practice certificates.real estate broker; along with that are 40 land consulting and trading floors licensed to operate by the province.

However, since Decree 02/2022 on real estate business conditions and especially Decree 16/2022/ND-CP regulating administrative penalties in the construction sector was issued, the number of people registering for certificates has skyrocketed. From February to now, 500 more people have applied for practice certificates. Currently, the Department has received and is expected to issue certificates in the next few weeks.

Article 59, Decree 16/2022/ND-CP stipulates a fine of 40-60 million VND for one of the following acts: conducting independent real estate brokerage business without a practice certificate or a practice certificate that has expired; erasing or correcting a real estate brokerage practice certificate to distort the content of the certificate; lending or renting or borrowing a real estate brokerage practice certificate to carry out activities related to real estate brokerage. A fine of 120-160 million VND for one of the following acts: conducting real estate services without establishing an enterprise as prescribed or not having enough people with a real estate brokerage practice certificate as prescribed or a practice certificate that has expired...

Most of the individuals participating have not been granted certificates and the transactions are not through the floor, so the risk is high and there is a risk of tax loss.

Mr. Nguyen The Phiet - Head of Real Estate Management Department, Department of Construction added: Previously, to be granted a certificate to practice this profession, citizens had to go through a course, but now this regulation has been abolished. In the near future, to implement the above regulation, together with the organization that grants certificates to people who need to broker and trade real estate, the Department will review and check the conditions of the floors; at the same time, propose measures to coordinate with relevant departments and localities to inspect and punish real estate brokers who do not have certificates or have certificates and licenses but operate improperly.

According to Clause 2, Article 3, Law on Real Estate Business 2014: Real estate brokerage is the act of intermediary between parties in buying, selling, transferring, leasing, subleasing, and leasing-purchasing real estate.
