Specifically, on February 28, Trung Viet Hung Company Limited illegally excavated soil and rock at the foot of Hai Vai, the western part of the slough, to make common construction materials with a volume of 380m3.3.

For the violation of the Law on Heritage, the People's Committee of Dien Chau district proposed that the Provincial People's Committee fine this enterprise 90 million VND. Len Hai Vai has many cultural and historical values. In 1964, during an archaeological survey, researchers discovered a number of fossil bones and stone tools of prehistoric people. In 1971, the Vietnam Institute of Archaeology, Hanoi University of Science, in collaboration with the Nghe An Department of Culture, conducted a survey and research at Len, discovering a number of artifacts, identified as belonging to the Phung Nguyen culture (dating back about 4,078 years ago). The above discoveries have determined that this is a place where primitive people lived.

In 1575, Hai Vai was a fierce battlefield during the Le - Mac conflict, the place where General Phan Cong Tich chose as a hiding place for the Le army, and also the place where the loyal mandarin Phan Cong Tich died. During the Can Vuong movement against the French, Hai Vai was the base of operations of Nguyen Xuan On. At the construction unit's material gathering site, a large amount of soil and rock was dug deep into the foot of the mountain to be leveled and transported to make a road to the foot of the construction site, about 300m3.

According to the report of the Chairman of Minh Chau Commune People's Committee, on February 15, Trung Viet Hung Company Limited worked with the Commune People's Committee on leveling and repairing the road at the foot of the hill to transport materials and machinery for the power line construction project. Minh Chau Commune People's Committee then agreed in writing to allow this unit to open a road around the hill along the people's path with a commitment not to take soil and rocks at the foot of the hill to affect the relic.
However, during the implementation process, the construction unit took soil and rock from the foot of the mountain to serve the project with a volume of about 300 m3.3to build a road from the foot of the mountain to the foundation construction site. Considering that the construction unit did not comply with the commitment, the Commune People's Committee suspended the project and requested the return of the soil and rock taken in the shortest time.
According to the leader of Trung Viet Hung Company, during the construction of the road, the excavator technicians did not know that this was a national relic, so they took away some of the soil and rock at the foot of the mountain to build a road to the foot of the construction site, leading to violations. After knowing that this was a national relic, the unit stopped the exploitation and returned the soil and rock that had been taken to build the road. The construction unit admitted its mistake and returned the soil and rock that had been taken.
A representative of the Department of Culture and Sports said that in the Regulations on management, protection and promotion of the value of historical - cultural relics and scenic spots in Nghe An province, the responsibility of the People's Committee at the commune level is stipulated as: "Organizing the management, preservation, protection and promotion of the value of relics in the area according to the assignment of the People's Committee at the district level".
