This is a regulation issued by the Ministry of Agriculture and Rural Development in Circular 31/2017/TT-BNNPTNT regulating working hours and rest hours for employees working in special fields in the field of natural disaster prevention, effective from February 20, 2018.
Accordingly, the subjects of application are agencies and organizations that prevent natural disasters and search and rescue that use or mobilize cadres, civil servants, public employees, and employees receiving salaries from the state budget (hereinafter referred to as employees) to do special work in the field of natural disaster prevention.
Employees doing special work in the field of natural disaster prevention at the Standing Office of the Central Steering Committee for Natural Disaster Prevention, Office of the Command Committee for Natural Disaster Prevention and Search and Rescue or the Standing Office of Natural Disaster Prevention and Search and Rescue of Ministries, branches, Office of the Command Committee for Natural Disaster Prevention and Search and Rescue at the provincial and district levels and the standing department of the Command Committee for Natural Disaster Prevention and Search and Rescue at the commune level (hereinafter referred to as the Office) or in areas affected by natural disasters.
This Circular does not apply to organizations and individuals of the people's armed forces including the People's Army, People's Public Security, Militia and Self-Defense Forces and employees not receiving salaries from the state budget.
Accordingly, the working hours of employees doing special jobs in the field of natural disaster prevention are different from those of employees doing normal jobs. Specifically, the maximum working hours are 8 hours/day and 40 hours/week, 8 hours less than those of employees doing normal jobs as prescribed in the 2012 Labor Code. The number of overtime hours must not exceed 4 hours/day and the total number of overtime hours must not exceed 300 hours/year.
In addition, employees on duty 24/24 are given compensatory leave and full pay. Employees on duty on weekdays are given 1 day off on the working day after their shift. Employees on duty on weekends, holidays and Tet are given 2 working days off after their shift.
Circular 31/2017/TT-BNNPTNT takes effect from February 20, 2018.
