The Ministry of Home Affairs has just completed a draft Decree (including 3 chapters and 15 articles) regulating the encouragement and protection of dynamic, creative cadres who dare to think, dare to do, and dare to make breakthroughs for the common good.

Today (March 24), Minister of Home Affairs Pham Thi Thanh Tra will chair a conference to contribute comments to this draft decree.

Many new problems arise that can easily cause risks.

The Ministry of Home Affairs said that innovation and creativity are always the right and necessary policies in the process of national renewal and international integration. Besides the achieved results, promoting the spirit of innovation, daring to think, daring to do, daring to break through for the common benefit of cadres still has certain difficulties and limitations.

According to the explanation of the Ministry of Home Affairs, the practical leadership, management and operation of many cadres still face many difficulties, obstacles and problems due to some Party regulations and State policies and laws that are not yet complete, many legal regulations are even overlapping, contradictory, lacking unity, synchronization or connectivity, and no longer suitable to reality.

Many new issues arise, without precedent, without regulations, without experience, easily causing risks, errors, damages or easily being exploited to commit violations and gain profits during the implementation process.

This makes it so that cadres in general, and leaders and managers in particular, have not yet been able to fully develop their capacity, spirit of innovation and creativity, and are even afraid of being considered for criminal responsibility or disciplined when there are shortcomings, violations, limitations and omissions.

Meanwhile, there are no strong enough mechanisms and policies to encourage cadres and especially there is a lack of mechanisms to protect cadres in cases where creative and innovative decisions are incorrect.

Key tasks in building a team of cadres

The Ministry of Home Affairs said that in the process of leading the revolution, the Party and State have always been consistent in their guidelines and viewpoints, gradually perfecting mechanisms, policies and laws to strongly arouse the sense of responsibility, desire to contribute, the spirit of innovation, creativity, daring to think, daring to do, daring to take responsibility for serving the people among cadres.

Specifically, the Resolution of the 4th Party Congress clearly stated that it is necessary to eliminate the mindset of "waiting and relying on the collective, fearing responsibility, and not daring to be decisive".

The political report of the 5th National Party Congress determined that it is necessary to pay special attention to discovering and including in the cadre team those who are "honest and dare to expose shortcomings and protect the truth for the common cause", and it is necessary to gather cadres with the spirit of "daring to make decisions and taking responsibility to complete tasks".

The Political Report of the 13th National Party Congress identified one of the tasks of building a socialist rule-of-law state as "having a mechanism to select, train, attract, and make good use of talents, and to encourage and protect cadres who dare to think, dare to speak, dare to do, dare to take responsibility, dare to innovate, dare to face difficulties and challenges, and be resolute in action for the common good."

Regulation No. 214 and Regulation No. 89 of the Central Government also require capacity and prestige. Leaders and managers must be dynamic, creative, diligent, hard-working, dare to think, dare to do, and serve the people.

Resolution No. 26 of the Central Committee has set out the task of protecting cadres who dare to think, dare to do, dare to break through, dare to take responsibility for the common interest; at the same time, considering the construction of a mechanism to protect cadres who dare to think, dare to do, dare to break through, dare to take responsibility for the common interest as a key task in building a contingent of cadres at all levels, especially at the strategic level, with sufficient qualities, capacity and prestige, equal to the task.

Conclusion No. 14/2021 of the Politburo expressed the Party's viewpoints and policies on the mechanism to encourage and protect dynamic, innovative, creative cadres who dare to think, dare to do, dare to break through, and dare to take responsibility for the common interest in the current period.

In Conclusion No. 21 dated October 25, 2021 of the 4th Conference of the 13th Party Central Committee on promoting Party building and rectification and the political system; resolutely preventing, repelling and strictly handling cadres and party members who have degraded in political ideology, ethics, lifestyle, and manifestations of "self-evolution" and "self-transformation", it is determined: "Well implement the policy of encouraging and protecting dynamic, creative cadres who dare to think, dare to do, and always strive to act for the common interest".

Therefore, institutionalizing the policy of our Party and State has identified promoting institutions for innovation and creativity as one of the core contents in the strategic breakthrough in perfecting institutions for development.

The development of this decree also institutionalizes and concretizes a number of mechanisms and policies to encourage innovation and creativity, such as: Policies for talented people in public service; policies to attract and promote individuals working in science and technology; regulations to encourage emulation and rewards, protection of intellectual property rights, and encouragement of emulation and creativity movements among the masses...

The Ministry of Home Affairs affirmed that the issuance of this decree is necessary to concretize the Party's policy, create a legal corridor to encourage and protect cadres who are innovative, creative, dare to think, dare to do, dare to break through, ready to face difficulties and challenges, always strive to act for the common interest; at the same time, contribute to preventing and handling cadres who take advantage of the above policy to commit illegal acts and seek personal gain.
