Many new and potentially risky issues have arisen, preventing officials from fully utilizing their capabilities, innovative spirit, and creativity, and even causing them to fear criminal prosecution or disciplinary action.

The Ministry of Interior has just completed the draft Decree (comprising 3 chapters and 15 articles) regulating the encouragement and protection of dynamic, creative officials who dare to think, dare to act, and dare to innovate for the common good.

Today (March 24), Minister of Home Affairs Pham Thi Thanh Tra will chair a conference to gather feedback on the draft decree.

Many new problems have arisen that pose potential risks.

The Ministry of Interior stated that innovation and creativity have always been correct and necessary policies in the process of national renewal and international integration. Alongside the achievements, promoting the spirit of innovation, creativity, and the courage to think, act, and make breakthroughs for the common good among officials still faces certain difficulties and limitations.

According to the Ministry of Interior, in practice, many officials still face numerous difficulties, obstacles, and problems in leading, managing, and operating their work due to the incompleteness of some Party regulations and State policies and laws. Furthermore, many legal regulations are overlapping, contradictory, lack consistency and coherence, or are no longer relevant to current practices.

Many new issues arise that are unprecedented, unregulated, and lack experience, easily leading to risks, errors, losses, or exploitation for wrongdoing and personal gain during implementation.

This has resulted in officials in general, and leaders and managers in particular, not being able to fully utilize their capabilities and spirit of innovation and creativity. They may even be afraid of facing criminal charges or disciplinary action when they have shortcomings, violations, limitations, or deficiencies.

Meanwhile, there are no sufficiently strong mechanisms or policies to encourage officials, and especially, there is a lack of mechanisms to protect officials in cases where innovative and groundbreaking decisions are flawed.

The central task in building a team of cadres.

The Ministry of Interior stated that, throughout the revolutionary leadership process, the Party and State have consistently maintained a unified approach and viewpoint, gradually improving mechanisms, policies, and laws to strongly awaken the sense of responsibility, the aspiration to contribute, the spirit of innovation and creativity, and the courage to think, act, and take responsibility for serving the people among the cadre.

Specifically, the Resolution of the 4th National Congress of the Party clearly stated that it is necessary to eliminate the mentality of "waiting and relying on the collective, fearing responsibility, and not daring to make decisive decisions."

The political report of the 5th National Party Congress emphasized the need to pay special attention to identifying and bringing into the ranks of cadres those who are "honest and dare to expose shortcomings and defend the truth for the common good," and to gather cadres who have the spirit of "daring to make decisions and daring to take responsibility to fulfill their tasks."

The Political Report of the 13th National Congress of the Communist Party of Vietnam identifies one of the tasks in building a socialist rule of law state as "having mechanisms to select, train, attract, and utilize talented individuals, encouraging and protecting cadres who dare to think, dare to speak, dare to act, dare to take responsibility, dare to innovate, dare to confront difficulties and challenges, and act decisively for the common good."

Central Committee Regulations No. 214 and No. 89 also require that leaders and managers possess competence and prestige, be dynamic, creative, diligent, hardworking, daring to think and act, and serve the people.

Resolution No. 26 of the Central Committee set forth the task of protecting cadres who dare to think, dare to act, dare to innovate, and dare to take responsibility for the common good; at the same time, it considered the building of a mechanism to protect cadres who dare to think, dare to act, dare to innovate, and dare to take responsibility for the common good as a central task in building a team of cadres at all levels, especially at the strategic level, with sufficient qualities, capabilities, and prestige, commensurate with the tasks.

Conclusion No. 14/2021 of the Politburo reflects the Party's views and policies on mechanisms to encourage and protect dynamic, innovative, creative cadres who dare to think, dare to act, dare to make breakthroughs, and dare to take responsibility for the common good in the current period.

In Conclusion No. 21 dated October 25, 2021, of the 4th Conference of the 13th Central Committee of the Communist Party of Vietnam on strengthening Party building and rectification and the political system; resolutely preventing, repelling, and strictly handling cadres and Party members who have degenerated in political ideology, morality, and lifestyle, and exhibiting "self-evolution" and "self-transformation," it is stated: "Effectively implement the policy of encouraging and protecting cadres who are dynamic, creative, dare to think and act, and always strive to act for the common good."

Therefore, in institutionalizing the Party and State's policy, promoting institutional reform and innovation has been identified as one of the core contents in the strategic breakthrough on perfecting institutions for development.

The drafting of this decree also simultaneously institutionalizes and concretizes a number of mechanisms and policies to encourage innovation and creativity, such as: policies for talented individuals in public service; policies to attract and utilize individuals working in science and technology; regulations encouraging emulation and reward, protecting intellectual property rights, and promoting emulation and creativity among the masses…

The Ministry of Interior affirmed that the issuance of this decree is necessary to concretize the Party's policy, create a legal framework to encourage and protect officials who are innovative, creative, daring to think, daring to act, daring to make breakthroughs, ready to face difficulties and challenges, and always striving to act for the common good; while also contributing to preventing and dealing with officials who abuse the above policy to act illegally or for personal gain.
