Increasing insurance compensation for motor vehicle owners, allowing the sale of parking spaces in apartment buildings, and arresting troublemakers in court... are prominent regulations that will take effect from April.

Increase compulsory insurance compensation for motor vehicle owners

Effective from April 1, Circular 22 of the Ministry of Finance stipulates that the liability of insurance companies for compensation for personal injury caused by motor vehicles is 100 million VND/person/incident instead of 70 million VND as at present.

The insurance liability for property damage caused by two-wheeled motorbikes, three-wheeled motorbikes, motorbikes and similar motor vehicles (including motor vehicles for the disabled) is 50 million VND/accident.

The insurance liability for property damage caused by automobiles, tractors, construction vehicles, agricultural and forestry vehicles and other special vehicles used for security and defense purposes (including trailers and semi-trailers pulled by automobiles or tractors) is 100 million VND/accident.

Shorten the time limit for granting permits to foreign workers

Also effective from April 1, Decree 11 of the Government detailing the implementation of a number of articles of the Labor Code on foreign workers working in Vietnam has shortened the time and procedures for granting permits to foreign workers. Specifically, tWithin 7 working days (currently 10 working days) from the date of receiving complete application documents, the Department of Labor, War Invalids and Social Affairs must issue a work permit to the foreigner.

In case of refusal to grant a license, the Department must have a written response stating the reasons.

General Department of Customs issues new one-stop mechanism

According to Decision 369 ofGeneral Department of Customs aboutRegulations on implementing the one-stop mechanism take effect from April 1,solve the problemrelated to import and export policies and activities when requested by organizations and individualswill be concentrated on one point through the guidance, reception and result return department (one-stop department).

Within 10 working days from the date of receiving a complete and valid tax exemption dossier, the professional unit must resolve the tax exemption for the organization or individual. In addition, no more than 5 working days from the date of receiving the request to resolve the problem of the organization or individual and the dossier is qualified, the professional unit must have a written response.

Allow buying and selling parking spaces in apartment buildings

According to Circular 2 of the Ministry of Construction on regulations on management and use of apartment buildings, effective from April 2, apartment owners will be allowed to buy and sell parking spaces in the apartment buildings they live in.

The investor must resolve to sell parking spaces for each apartment and apartment buyers in need when the apartment building has enough space. In case there are not enough parking spaces for each apartment, the investor will resolve to sell or lease these parking spaces based on the agreement between the apartment buyers; in case the apartment buyers cannot reach an agreement, the investor will resolve by drawing lots to buy or lease these parking spaces.

In addition, the Circular also provides a model of internal regulations with contents such as strictly prohibiting acts that cause insecurity and disorder, swearing, cursing, arguing; prohibiting the use of radios, televisions or devices that emit excessive sound that affects common activities; prohibiting throwing objects from windows, balconies, raising livestock, poultry, defecating, and discharging waste that pollutes the environment...

Residents living in apartments are not allowed to dry clothes on railings or windows, nor are they allowed to arbitrarily change the function or purpose of common areas.

The person causing trouble in court will be arrested.

Effective from April 24, Circular 13 of the Ministry of Public Security details the protection of court sessions by the people's police force. Accordingly,The police are responsible for strictly controlling the participants in the trial according to the summons and invitations of the court. Each trial has at least 2 soldiers participating in protection, arriving 30 minutes before the opening.

The police are responsible for forcing violators of court order and rules to leave the courtroom or arrest them according to the decision of the presiding judge. When a situation of a large crowd gathering and causing disorder in the courtroom occurs, the police on duty must propagate and request everyone to disperse and stop the behavior.

If not accepted, the police protecting the court are allowed to arrest the opponents, masterminds, and ringleaders.
