Aggravating circumstances for party organization and party member violations according to new regulations of the Politburo

(Baonghean.vn) - These contents are shown in Regulation No. 69-QD/TW of the Politburo on disciplining Party organizations and Party members who violate the law, which was conveyed at the online training conference on professional inspection and supervision work in the Party organized by the Standing Committee of the Provincial Party Committee on the afternoon of November 23.

The conference listened to comrade Ha Cong Nghia - Deputy Head of Department III of the Central Inspection Commission, explain the topic: Party discipline and discipline enforcement in the Party.

In particular, according to Regulation No. 69, if a violation has one or more of the following circumstances, the disciplinary level must be considered and increased. Specifically, for party organizations, the following circumstances include: Failure to promptly correct shortcomings and violations according to the conclusion of the party organization or competent authority; failure to voluntarily admit shortcomings and violations.

Repressing those who fight, denounce, testify, or provide evidence of violations; dealing with, obstructing, causing difficulties, or hindering the process of investigating, verifying, and collecting evidence of violations; covering up or concealing violations.

Providing false information and reports; threatening or forcing others to not provide evidence or documents; not providing or providing incomplete information or destroying documents and evidence related to the violation; creating fake records, documents and evidence to deal with the violation.

Taking advantage of emergency situations, natural disasters, fires, epidemics, social security policies, national defense and security for personal gain. Violating for the second time or more, systematically or having been disciplined but continuing to violate; deliberately delaying or prolonging the time for consideration, handling and remedy, making the situation of the organization, agency or unit increasingly complicated. Knowing but failing to prevent or allowing cadres and party members under the organization under their direct management to commit corruption; negativity causing serious consequences.

For party members, there are the following circumstances: Having been requested by the party organization to review but not doing so, not correcting shortcomings and violations. Not voluntarily admitting shortcomings and violations, the form of discipline is commensurate with the content, nature and level of the violation; causing material damage that must be compensated but not compensated, not remedying the consequences or remedying them not in accordance with the requirements of the competent authority, not voluntarily returning money and property acquired from the violation.

Dealing with, circumventing, obstructing the process of inspection, supervision, examination, auditing, investigation, prosecution, trial, and execution of judgment. Covering up for violators; threatening, repressing, and taking revenge on those who fight, denounce, testify, or provide documents and evidence of violations.

Organized violations, being the mastermind; providing false information and reports; preventing others from providing evidence of violations; concealing, modifying, destroying evidence, creating fake documents, records, and evidence.

Taking advantage of one's position, power, taking advantage of a state of emergency, natural disaster, fire, or epidemic to implement social security, national defense, and security policies for personal gain. Forcing, mobilizing, organizing, or assisting others in committing violations.

Disciplinary measures according to Regulation No. 69 for party organizations include: Reprimand, warning, and dissolution. For official party members include: Reprimand, warning, dismissal (if holding a position), and expulsion. For probationary party members include: Reprimand, warning.

Regulation No. 69 also specifies the statute of limitations for disciplining party organizations that violate the law. Specifically, for party organizations, it is 5 years (60 months) for violations that require a reprimand; 10 years (120 months) for violations that require a warning. The statute of limitations for discipline does not apply to violations that require a disciplinary measure of dissolution; violations of internal politics; and violations of national defense, security, and foreign affairs that harm national and ethnic interests.

The statute of limitations for discipline does not apply to violations that require expulsion; internal political violations; violations of national defense, security, and foreign affairs that harm national and ethnic interests; and illegal use of diplomas, certificates, and certifications.

Inspect lower-level Party organizations and Party members when there are signs of violations.
