Fines up to 200 million VND for posting distorted and defamatory information

This is a proposal in the draft Decree of the Government regulating sanctions for violations in press and publishing activities, drafted by the Ministry of Information and Communications, seeking public comments.

The draft specifically proposes penalties for violations of regulations on information content.

Fine from 140 to 200 million VND for one of the following acts:Posting or broadcasting information with content that distorts, defames, denies the people's government, fabricates, causes confusion among the people, and causes psychological warfare, but not to the extent of criminal prosecution; posting or broadcasting information with content that incites war against the independence, sovereignty, and territorial integrity of the Socialist Republic of Vietnam, but not to the extent of criminal prosecution; posting or broadcasting information that distorts history, denies revolutionary achievements, or insults the nation or national heroes, but not to the extent of criminal prosecution;

The above penalty level also applies to the following acts: Posting or broadcasting information that causes hatred, discrimination, division, ethnic secession, infringes upon the right to equality in the community of Vietnamese ethnic groups, causes division among the people, between the people and the people's government, the people's armed forces, political organizations, socio-political organizations, causes division between religious people and non-religious people, between people of different religions, divides religious believers and the people's government, political organizations, socio-political organizations but not to the extent of criminal prosecution; posting or broadcasting information that offends religious beliefs, religions, and undermines the implementation of international solidarity policies but not to the extent of criminal prosecution; disclosing information in the list of state secrets but not to the extent of criminal prosecution; Print, publish, transmit, broadcast press products, press works that have been suspended from publication, recalled, confiscated, banned from circulation, removed, destroyed, or information content that has been corrected by the press agency.

Also according to the draft, a fine of 40 - 60 million VND will be imposed for one of the following acts: Posting or broadcasting false information causing very serious consequences; posting or broadcasting news, articles, or photos inciting violence or promoting depraved lifestyles.

Revealing personal secretsfined from 2-6 million VND

The draft proposes a fine of 2-6 million VND for one of the following acts: Posting or broadcasting false information that has not yet caused serious impact; illustrating or shortening headlines that do not match the content of the information, causing readers to misunderstand the content of the information; disclosing personal privacy and other secrets as prescribed by law; publishing personal documents or letters without the consent of the legal owner of such documents or letters, except in cases where the law provides otherwise; posting or broadcasting photos of individuals without their consent, except in cases where the law provides otherwise.

Fines of 10 - 20 million VND shall be imposed for one of the following acts: Posting or broadcasting false information causing serious consequences; meticulously describing obscene acts, criminal acts, and gruesome accidents in news, articles, and photos; posting or broadcasting information that affects the normal physical and mental development of children...
