It is expected that on May 11th, at its 23rd session, the Standing Committee of the National Assembly will consider the draft Resolution amending and supplementing Resolution No. 85/2014 of the 13th National Assembly on taking votes of confidence and no-confidence votes for those holding positions elected or approved by the National Assembly and People's Councils.

This content is also being considered by the Standing Committee for inclusion in the 2023 legislative and ordinance drafting program to be submitted to the National Assembly for approval at the upcoming 5th session.

Nguyen Thi Thanh, Head of the Committee on Delegate Affairs, spoke at the seminar "Resolution on taking votes of confidence and no-confidence votes for those holding positions elected or approved by the National Assembly and People's Councils - issues needing improvement" on April 18th.

According to the draft being circulated for comments by the Committee on Delegate Affairs (Standing Committee of the National Assembly), the National Assembly will hold a vote of confidence for: the President, the Vice President; the Speaker of the National Assembly, the Deputy Speakers of the National Assembly, members of the Standing Committee of the National Assembly, the Secretary General of the National Assembly, the Chairman of the National Ethnic Council, and the Chairmen of the National Assembly Committees; the Prime Minister, Deputy Prime Ministers, Ministers, and other members of the Government; the Chief Justice of the Supreme People's Court, the Prosecutor General of the Supreme People's Procuracy; and the State Auditor General.

The purpose of votes of confidence is to enhance the effectiveness and efficiency of the National Assembly and People's Councils' oversight activities; improve the quality and efficiency of the State apparatus; contribute to assessing the prestige and performance of those subject to the votes of confidence, helping them to see their level of trust so they can self-reflect, self-correct, and continue to strive, train, and improve the quality and efficiency of their work.

Assigning them to a lower-level position without waiting for the end of their term.

The results of the confidence vote are reported to the competent authority and made public as prescribed, serving as a basis for competent agencies and organizations to consider and evaluate officials.

One of the criteria used to assess the level of trust in a person being subjected to a vote of confidence is their ability to unite and foster internal cohesion, and to handle difficult, complex, and sensitive issues.

In addition, the results of leadership and guidance in implementing policies and regulations on combating corruption and negative practices; and the exemplary conduct of the individual and their spouse and children in complying with the State's policies and laws are also considered when conducting the confidence vote.

Another basis for a vote of confidence is the performance of assigned duties and responsibilities, including leadership in organizational and personnel matters; combating corruption and negative practices; inspection and supervision; and handling complaints and denunciations within the assigned field and scope.

A person who receives a "low confidence" rating from more than half but less than two-thirds of the total number of National Assembly deputies or People's Council deputies may resign, or the National Assembly or People's Council may hold a vote of no confidence at the nearest session.

If a person subject to a vote of confidence receives a "low confidence" rating from 2/3 or more of the total number of National Assembly deputies or People's Council deputies, the competent authority shall submit a proposal to the National Assembly or People's Council to dismiss them at the nearest session.

The ballots used in confidence votes include levels of "high confidence," "confidence," and "low confidence." The ballots used in votes of no confidence have levels of "confidence" and "no confidence."

The National Assembly is expected to hold a vote of confidence for positions elected and approved by the National Assembly at its 6th session in October 2023.

Previously, the National Assembly had held three confidence votes for positions elected and approved by the National Assembly. Specifically, at the 6th session of the 14th National Assembly, National Assembly deputies held confidence votes for 48 positions; in 2013, the National Assembly held confidence votes for 47 people, and in 2014, for 50 people.
