Amending the Law on Inspection: Should the district-level inspection model be abolished or maintained?

(Baonghean.vn) - Regarding the draft Law on Inspection (amended), regarding the model of district-level inspection organization, during the discussion process, there are two streams of opinions: first, agreeing to continue maintaining the district-level inspection organization model and second, not organizing a district-level inspection agency.

On the afternoon of May 26, National Assembly deputies discussed in groups the Draft Law on Inspection (amended). Comrade Thai Thanh Quy - Member of the Party Central Committee, Secretary of the Provincial Party Committee, Chairman of the Provincial People's Council, Head of the National Assembly Delegation of Nghe An chaired the discussion in Group 11 including deputies from the provinces: Bac Giang, Khanh Hoa and Nghe An.

Regarding the draft Law on Inspection (amended), regarding the district-level inspection organization model, there are two streams of opinion during the discussion: first, agreeing to continue maintaining the district-level inspection organization model and second, not organizing a district-level inspection agency.

Speaking at the group discussion in the afternoon of the same day, delegate Vo Thi Minh Sinh - Member of the Provincial Party Standing Committee, Chairman of the Vietnam Fatherland Front Committee of Nghe An province expressed her opinion, "where there is management, there must be inspection"; thereby agreeing to keep the district-level inspection as before, but it is necessary to strengthen the capacity of the inspection team at this level.

Previously, in the working session on the morning of May 26, when presenting the report on the review of the draft Law on Inspection (amended), Chairman of the Law Committee Hoang Thanh Tung said: The majority of opinions in the Law Committee agreed with the first type of opinion, which is to continue maintaining the model of organizing district-level Inspectors.

Also related to the draft Law on Inspection (amended), regarding the related content, organization, functions, tasks, and powers of State inspection agencies, delegate Vo Thi Minh Sinh expressed concerns about the appropriateness of allowing the establishment of inspection organizations in general departments and bureaus of ministries and branches. Is this content consistent with the Party and State's policies and guidelines on streamlining focal points such as Resolution No. 18-NQ/TW dated October 25, 2017, the 6th Conference of the 12th Party Central Committee on a number of issues on continuing to innovate and reorganize the apparatus of the political system to be streamlined, effective and efficient?

Resolution No. 56/2017/QH14 of the National Assembly on continuing to reform the organization of the State administrative apparatus to be streamlined, effective and efficient also clearly states: not incorporating regulations on organization and staffing into laws, ordinances and resolutions of the National Assembly, the National Assembly Standing Committee does not belong to the field of State apparatus organization. The delegate also said that in the draft law, the opinion of the Central Organizing Committee has not been sought, while this is the Standing body of the Central Steering Committee on staffing management;...

According to the female delegate of Nghe An Delegation, if the establishment of inspection organizations in the general departments and departments of ministries and branches is allowed, the administrative and staffing levels will increase. Regarding this content, the increase must start from increasing functions and tasks, then the apparatus and job positions will increase. However, in the presentation, there is no Project to perfect and rearrange the organization of the apparatus of inspection agencies through job positions. In the explanation of the Government Inspectorate, it said that because there was a report on 10 years of implementing the Inspection Law, the above Project was not implemented. However, according to the delegate, the structure of this Project is completely different from the implementation of the Inspection Law in 2010.

Based on that analysis, delegate Vo Thi Minh Sinh proposed to carefully consider and review this regulation to be consistent with the content of the draft law and the Party's policy on unification and management of the payroll.

Delegate Vo Thi Minh Sinh also expressed concern that the Draft Law on Inspection (amended) does not include any content on building a strategy for the Inspection sector; while almost all ministries and sectors have built their own sector strategies, so she requested further clarification...
