Piloting public-private partnership mechanism, co-funding to implement science and technology tasks

Develop and pilot a public-private partnership mechanism, co-fund a number of science and technology programs in the direction of mobilizing resources and the participation of many different partners to solve major problems of the industry and field; promote cooperation and connection between enterprises, science and technology organizations, state management agencies and relevant parties to contribute to improving investment efficiency in science and technology activities.

The project "Piloting a public-private partnership mechanism and co-funding the implementation of science and technology tasks" has just been approved by the Prime Minister.

The public-private partnership and co-financing mechanism (abbreviated as PPP) for implementing science and technology tasks is established on the basis of public and private partners signing an agreement to contribute resources to jointly identify and implement science and technology programs and exploit and use the results.

The science and technology programs to be piloted under the PPP mechanism selected in the Project (referred to as the Program) are science and technology issues that play an important role in improving the competitiveness of economic sectors and groups; developing priority science and technology fields; and contributing to solving urgent socio-economic problems.

Partners contributing resources to implement the Program include: Public partners are ministries, ministerial-level agencies, government agencies, People's Committees of provinces and centrally run cities (hereinafter referred to as ministries, branches, and localities); financial institutions operating mainly on the state budget; private partners are enterprises and organizations operating for profit purposes established in accordance with Vietnamese law. The contribution of private partners accounts for no less than 40% of the total resources to implement the Program; bilateral and multilateral development cooperation organizations, funds, and other organizations and individuals participating in contributing resources to implement the Program are counted as the contribution of public partners or private partners depending on each specific case.

Contributed resources from public partners are given priority to organizations and individuals working in science and technology, and small and medium-sized enterprises participating in implementing the Program's topics and projects.

The determination and adjustment of the list of topics and projects under the Program and the selection of groups of enterprises, organizations and individuals to implement them are decided by councils with 50% of members representing public partners and 50% of members representing private partners.

Benefits from the Program are divided according to the ratio of resource contributions of partners, or according to other agreements. Damages and risks (if any) related to the Program are shared according to the ratio of resource contributions or according to other agreements but not exceeding the actual contribution of each partner in the Program.

Program Establishment

The Ministry of Science and Technology shall preside over and coordinate with ministries, branches, localities, the business community, scientific and technological organizations and relevant parties to organize the identification and selection of Programs based on prescribed criteria and procedures.

Public and private partners have committed to contributing resources and sending representatives to sign a public-private partnership contract to establish the Program with main contents including: Objectives; scale; implementation time; expected list of topics, projects and plans to ensure resources for implementation; regulations on financial and asset management (including related intangible assets); establishment and operation of the Program Management Board (Management Board) to manage and organize the implementation of the Program; other issues of interest to the parties.

Regarding the implementation of the Program, the Steering Committee will establish a council to determine, amend and supplement the detailed list of topics and projects of the Program and publicly announce it for enterprises, organizations and individuals to register to participate in the selection; establish a council to select enterprises, organizations and agencies to implement topics and projects of the Program based on prescribed criteria and procedures; submit to competent authorities for approval the list of topics and projects of the Program and enterprises, organizations and individuals to implement according to prescribed procedures and procedures; monitor and periodically evaluate the implementation; organize the acceptance of the results of implementing topics and projects of the Program according to prescribed procedures and procedures.

Encourage organizations to contribute resources to participate in the Program.

Regarding resource mobilization for the implementation of the Program, domestic and international organizations are encouraged to contribute resources to participate in the Program. The contribution to the Program in cash, assets or services is considered an investment in science and technology and enjoys incentives according to the provisions of law; focus and integrate state budget funds from science and technology tasks, different programs and projects with appropriate goals to contribute to the implementation of the Program.

When implementing the Program's topics and projects, enterprises, organizations and individuals are given the highest priority and incentives according to the law in using equipment, laboratories and other necessary facilities of the State; and are given priority in exploiting databases and intellectual properties owned by the State.

Regarding the financial regime in implementing the Program's topics and projects and other activities of the Project, the most favorable content, norms and spending methods prescribed in current legal documents or applied to other specific scientific and technological tasks shall be applied; the groups in charge of implementing the Program's topics and projects shall proactively adjust the budget, apply the payment and spending regime within the limits approved by the competent authority.

Enterprises, organizations and individuals contributing resources to implement the Program's topics and projects are given priority in using the results in accordance with legal regulations; the results of implementing the Program's topics and projects are given priority in public procurement investment activities; and are given priority in using them as national standards in appropriate fields.
