Standards and conditions for members of the People's Inspectorate

DecreeDecree 159/2016/ND-CP detailing and implementing measures for a number of articles of the Law on Inspection on the organization and operation of the People's Inspectorate has just been issued by the Government.

This Decree details and provides measures for implementing a number of articles of the Law on Inspection on the organization and operation of People's Inspection Committees in communes, wards, towns and state agencies, public service units, and state-owned enterprises.

People's inspection boards are established in communes, wards, towns, state agencies, public service units, and state-owned enterprises to supervise the implementation of policies and laws, the settlement of complaints, denunciations, recommendations, and reflections, and the implementation of laws on democracy at the grassroots level by agencies, organizations, and individuals, contributing to promoting democracy, fighting against corruption and negativity, and protecting the legitimate rights and interests of citizens, agencies, organizations, and units.

The Decree specifically stipulates the standards and conditions for members of the People's Inspectorate, including:

1- Members of the People's Inspection Committee must be honest, fair, reputable, knowledgeable about policies and laws, and voluntarily participate in the People's Inspection Committee.

2- Members of the People's Inspection Board in state agencies, public service units, and state-owned enterprises must be people who are currently working at state agencies, public service units, and state-owned enterprises and must not be the head or deputy head of such agencies, organizations, or units. People elected as members of the People's Inspection Board must have at least the remaining working time equal to the term of the People's Inspection Board.

3- Members of the People's Inspection Committee at the commune, ward or town level must be permanent residents of the commune, ward or town level and must not be incumbent members of the People's Committee at the commune, ward or town level.

The People's Inspectorate operates on the principles of objectivity, publicity, transparency, democracy and timeliness; works collectively and makes decisions by majority vote.

It is strictly forbidden to threaten, retaliate, or harass members of the People's Inspection Committee; to take advantage of the duties and powers of the People's Inspection Committee to incite, entice, or entice others to make false complaints or denunciations and to commit illegal acts.

The Decree takes effect from February 1, 2017.
