Question: Are domestic economic organizations that are allocated land by the State with land use fees entitled to lease land use rights? This is a matter of concern for Ms. Hoang Mai Hong (Nghi Loc, Nghe An).

Reply: Clause 1, Article 33 of the 2024 Land Law stipulates the rights and obligations of domestic organizations that are allocated land by the State with land use fees collected, and leased land with one-time land rental fees collected for the entire lease term as follows:

1. Economic organizations that are allocated land by the State with land use fees collected, or leased land with one-time land rental fees collected for the entire lease term have the following rights and obligations:

a. General rights and obligations stipulated in Articles 26 and 31 of this Law;

b. Transfer of land use rights and assets owned by oneself attached to the land;

c. Lease land use rights and assets owned by oneself attached to land in cases where the State allocates land with land use fees collected; sublease land use rights and assets owned by oneself attached to land in cases where the State leases land with one-time land rent collection for the entire lease term;

d. Donate land use rights to the State; donate land use rights to residential communities to build works serving the common interests of the community or expand traffic routes according to planning; donate land use rights to build gratitude houses, charity houses, and solidarity houses attached to the land according to the provisions of law;

Thus, domestic economic organizations that are allocated land by the State with land use fees are entitled to lease land use rights.
