Why do citizens of Gia De hamlet often organize complaints?
(Baonghean) - Nghe An Newspaper had a dialogue with comrade Pham Hong Linh - Secretary of the Party Committee of Nghia Dung Commune (Tan Ky) about the case of more than 50 people in Gia De hamlet filing a complaint beyond their level.
PV: Could you please provide some information about the case of 50 citizens of Gia De hamlet filing a lawsuit at higher levels? Is the reason because the people do not agree with the policy of sand and gravel mining in the area or are there other reasons?
Comrade Pham Hong Linh:In February 2015, Nghia Dung Commune People's Committee received a notice from Tan Ky District People's Committee along with the Decision No. 19/GP - UBND dated January 6, 2015 of the Provincial People's Committee on granting a license to exploit construction sand and gravel minerals to Hoang Dinh Lam private enterprise at the alluvial sand site of Gia De hamlet. After receiving the dossier to grant the mine to the enterprise, the Commune People's Committee notified the Party Committee and the Executive Committee of Gia De hamlet where the mine is located. However, the cadres and people of Gia De hamlet did not agree to grant the mine to Hoang Dinh Lam enterprise.

Why do Gia De officials and people disagree? Regarding objective reasons, people believe that sand mining at this alluvial land will change the flow, which will cause natural disasters; it will be more difficult for people to travel to the alluvial land next to where they grow corn, and at the same time, it will cause the loss of cultivated land left by their ancestors.
Subjectively, the enterprise has not had any dialogues to meet the people's thoughts and wishes. In the commitment documents, there is an agreement that the enterprise will compensate if it changes the flow or causes landslides in nearby cultivated land. But according to the people, once it has the right to exploit the land, this enterprise will not fulfill those commitments because the people think that this enterprise has ethical problems.
“Gia De is a famous locality for petitioning at higher levels. Whenever there is a policy that people disagree with, they immediately gather together and go to the district, the province, and even the Central Government. And strangely, every 10 years there is a major petition at higher levels. A typical example is in 1996, when people arbitrarily built a transformer station without following the commune's policy. When the government suspended it and asked the transformer station owner to comply with current regulations of the State, the people protested and organized a "rice-wrapping" protest all the way to the Central Government,” according to comrade Pham Hong Linh.

The second time was in 2006 when the province had a policy of dividing the boundary according to the 365 map between Nghia Dung and Tan Long. According to the measurement, the area of Con Noi beach belongs to the administrative map of Tan Long commune, but the people insisted that Gia De's ancestors had cultivated here for generations, so they refused to follow the divided boundary. So they filed a lawsuit again, from the province to the Central Government. The commune had to hire a car to pick them up and return. And in both of those lawsuits, to stabilize order and security in the area, we had open mechanisms to respond to the rights and wishes of the people. Now, in this event, the people think that if they sue, they will "win", so they invite each other to sue to the end.
PV:After temporarily suspending the mining license for Hoang Dinh Lam enterprise, how is the security and order situation in the area, comrade?
Comrade Pham Hong Linh:In general, everything is fine, people still fully participate in the village and commune meetings. However, they do not agree with allowing businesses to exploit sand. Typically, recently they brought more than 197 bamboo trees to the licensed exploitation area... Besides, with only the Party cell secretary still supporting the policy, both cadres and people asked him to resign.
Faced with this incident, we have mobilized the entire political system to take action with the motto of "pacifying the people". Therefore, for party committees and authorities at all levels, comrades in the Party cell must stick close to the grassroots and flexibly use propaganda methods. At the same time, members of any association must have a form of propaganda so that their members understand the provisions of the law.
PV:So, as requested by the province, has the commune organized dialogues between businesses and people, and after these dialogues, what are the people's thoughts?
Comrade Pham Hong Linh:After the province decided to stop granting licenses to Hoang Dinh Lam enterprise, the district also chaired many dialogues to resolve problems between people and enterprises, helping people understand the policies as well as the necessary things for the enterprise to exploit the mine. Accordingly, both the district and the commune clearly explained in writing as well as through dialogue with the people that in order to exploit, the functional sector had conducted a geological survey process and committed to not having land subsidence as the people were worried. In addition, we also required the enterprise to have certain negotiations with the people, but the enterprise itself also lost confidence in the dialogue, so the people were not satisfied with the enterprise's behavior.
PV:So, with the mobilization of 197 bamboo poles to fence off the business from exploitation, what method has the commune used to prevent it?
Comrade Pham Hong Linh:On November 30 and December 1, 2015, we learned that some people were transporting bamboo poles to the hamlet. At first, we did not know that they were going to plant bamboo poles in the alluvial land that had been approved for exploitation, but by evening, many people had secretly gone to the land to participate. Early in the morning, the alluvial land was already full of bamboo poles, and they even assigned people to guard it. In that situation, we went directly to the scene to mobilize people to strictly comply with the law and not plant bamboo in the mining areas that were showing signs of dispute. We reported this to the district and asked for instructions. However, in this situation, the district also requested that no enforcement or punishment be given to people who violated the law to avoid any unfortunate frustration that could occur.
PV:So, before the cadres, people and Gia De Party Cell requested comrade Le Van Lan to resign from the position of Party Cell Secretary, what solution have we come up with?
Comrade Pham Hong Linh:Firstly, the political system of Gia De hamlet has been dragged into this incident by some people. We have met with each person to propagate and mobilize them to comply with the policy and regulations of the law. Recently, two officials in the executive committee who resigned have returned to their duties, and we have appointed a new head of the women's association. Therefore, the situation in Gia De is currently stable, and the political system has returned to normal operation.
Let's talk about the Gia De Party Cell's harsh request for comrade Le Van Lan to resign from the position of Party Cell Secretary. This is a serious violation of Party regulations and statutes by Party members in this Party Cell. Firstly, comrade Le Van Lan did not do anything wrong and did not violate Party regulations during his leadership and direction in Gia De hamlet, so he cannot be asked to resign. The fact that he did not agree with the majority of opinions of the people here and asked him to resign is an unreasonable request, unfounded and contrary to Party regulations and the law.
PV:What the public and the government are worried about is whether the situation will be stable during the upcoming election, and how has the locality carried out the propaganda for the first consultative election?
Comrade Pham Hong Linh:According to the regulations on procedures, we also organized the introduction of 2 candidates from Gia De hamlet to run for election. Regarding propaganda work, we conducted propaganda through meetings and radio broadcasts to the hamlets. Particularly for Gia De hamlet, we also distributed documents on the regulations on candidates and the procedures for the election of the People's Council and National Assembly deputies for the 14th term of 2016 - 2021 to the hamlets. Meanwhile, with the remaining 12 hamlets in Nghia Dung, people did not have any questions after the first consultation.
However, in Gia De alone, we had to hold meetings three times to get it "through". On March 14, we will hold a second consultation with the delegates nominated to run for the commune level. According to the situation we have grasped, everything will go smoothly, and the people will have no questions or objections.
