Need to remove 'bottlenecks' to hand over land for the project to renovate and upgrade National Highway 7 through Yen Thanh district
(Baonghean.vn) - Many households in Vien Thanh commune (Yen Thanh) have not yet agreed to sign the documents to hand over the site to the construction unit of the National Highway 7 renovation and upgrading project. In addition, due to the lack of continuity in construction, many areas have stagnant water when it rains, causing environmental pollution.
Many recommendations on compensation policy
ProjectUpgrading National Highway 7The Km0 - Km36 section and the handling of landslides caused by storms and floods in the Khe Thoi - Nam Can section, Nghe An province, were approved for investment in Decision No. 1338/QD-BGTVT dated July 20, 2021 with a total investment of VND 1,300 billion, with Project Management Board 4 as the investor. This is the second project in the medium-term public investment plan for the period 2021 - 2025 approved by the Ministry of Transport. The project aims to gradually complete the traffic infrastructure of National Highway 7 according to the plan; strengthen connectivity, improve exploitation capacity, ensure smooth traffic on the transport corridor from Nam Can border gate (connecting with Laos) to the coastal provinces of the Central region; effectively promote previously invested sections; create conditions to support local socio-economic development, ensure regional defense and security.

Currently, the project is being urgently implemented by contractors, the busiest is along Dien Chau, Yen Thanh, Do Luong districts. In Yen Thanh district, the project passes through 5 communes: Vinh Thanh, Vien Thanh, Bao Thanh, Cong Thanh, My Thanh with a length of about 27km. To implement the project, the Compensation Council of Yen Thanh district has established a compensation plan, support for land acquisition for affected subjects of the communes, and has publicly collected opinions and carried out payment procedures in some localities.
However, in Vien Thanh commune, with a length of more than 2km, affecting 72 households and 73 plots of land, although more than 1 year has passed since the project was implemented, many sections have not been completed by the investor and contractors because 14 households have not received money; 6 households are not affected but have not handed over the land.

During the process of publicly posting the draft compensation and site clearance support plan for this project, Yen Thanh District People's Committee also received many complaints both directly through dialogue sessions as well as through petitions from the people.
Mr. Ngo Van Men, currently residing in Hamlet 4, Vien Thanh Commune, said: To implement this project, his family received a compensation notice of 9.1m2However, according to Mr. Men, the actual affected area is 53m2Therefore, he requested to survey and re-measure the compensation area and put the recovered area of the family into the recovery list so that the family would be compensated according to the actual area of 53m2.2along with the property on the land.
Or like the family of Mr. Nguyen Huu Bon, residing in hamlet 6, Vien Thanh commune, reported that his family had 18.2m confiscated.2on a total area of 339.2m2However, according to the public plan, the architectural structures on the land that were recovered from the family, including the business kiosk with a corrugated iron roof, the surrounding fence system, the cement yard, etc., will not be compensated, so Mr. Bon's family requested a clear explanation of the reason why.
Among the 14 households petitioning in Vien Thanh commune, most of them have questions about the compensation value. The households also compare the compensation levels between different households, and also think that the compensation is not really transparent... so the people have not signed to receive the land handover.
Most recently, on December 20, 2023, the Compensation and Site Clearance Council of Yen Thanh district issued a document responding to citizens regarding their petitions and concerns. In this document, the People's Committee of Yen Thanh district responded specifically and in detail to the questions, in which the reason why households were not compensated or the compensation level was low was mainly determined to be due to land encroachment, or construction on vacant land, not included in the Land Use Rights Certificate, so they were not compensated...

Impact on overall progressof the project
On December 29, 2023, the Provincial People's Committee also issued Document No. 11226/UBND-CN on resolving all existing problems and difficulties related to compensation and site clearance work at this project. For Yen Thanh district, the Provincial People's Committee assigned the completion of the approval of the compensation plan to pay people to hand over the remaining clean land before January 10, 2024. However, this deadline was not met.
According to Mr. Nguyen Van Duong - Vice Chairman of the District People's Committee, who is also Chairman of the Compensation and Site Clearance Council of Yen Thanh District, the district has received recommendations and feedback from the people, and has responded many times, however, up to this point, the people still do not agree. The reason for the differences in compensation is because the time of land use by the people is different. Most of the people build on the airspace within the planning boundary of National Highway 7. The recommendations of the people have been responded to by the district in documents and at dialogues, and reported to the Provincial People's Committee for consideration and resolution.
Most recently, on January 8, 2024, Yen Thanh District People's Committee continued to dialogue with households in Vien Thanh commune, but the people still did not agree.

In addition to the problems related to site clearance, currently according to the petition of local people, because 14 households have not yet handed over clean land to the construction unit, the project implementation has not been seamless, creating large puddles when it rains, causing environmental pollution.
According to the investor's report, the section through Yen Thanh district extends from Km9+180-Km24+600. Currently, the district has not handed over all the land in a total of more than 27km (left and right of the route), so the contractors do not have land to construct. In addition, some sections of the land have been handed over, but when implementing, some households obstructed the construction, so the construction was interrupted, causing the drainage ditches to not be cleared, leading to stagnant water in some places in the ditches, causing environmental pollution and frustration for people passing through this area, especially from Khe Cat bridge (Bao Thanh commune), to hamlet 6, Vien Thanh commune.

On January 9, 2024, the Department of Natural Resources and Environment issued Document No. 186/STNMT-QLDD regarding difficulties in compensation and site clearance for the project to upgrade National Highway 7A through Yen Thanh district.
Accordingly, the Department of Natural Resources and Environment requested the People's Committee of Yen Thanh district to check and review each file for land used before December 18, 1980, which has a part of the road that must be recovered. In case of stable land use, no compensation over the periods and complete documents, compensation, support and resettlement will be considered when the State recovers land to implement the project according to regulations.
At the same time, check and review the current status of land use, origin, and implementation of financial obligations for cases related to illegal land sales before July 1, 2004. For cases with guaranteed records, the District People's Committee shall propose other support and submit to the Provincial People's Committee for approval.
According to Mr. Duong, the district has sent the recommendations and feedback on the construction progress of the people to the investor. The district also requires the investor to hand over the site to the construction site to ensure the proposed progress as well as not causing traffic jams and affecting the environment.
“Regarding the people's recommendations on land acquisition and compensation, in the coming time, local authorities and specialized agencies will continue to propagate and mobilize people to clearly understand the provisions of the law to promptly hand over to the construction unit, ensuring the completion of the set goals" - Mr. Duong emphasized.
