Specifically, Decree No. 54/2022/ND-CP amends and supplements Clauses 2 and 3, Article 65 on specialized state management at ports, inland waterway wharves, and anchorage areas in Decree No. 08/2021/ND-CP.

According to the new regulations, the port authority under the Vietnam Inland Waterways Administration performs specialized state management functions at ports, inland waterway wharves (except for cross-river passenger wharves), anchorage areas that have been announced and licensed to operate on national inland waterways, specialized inland waterways connecting to national inland waterways; ports, inland waterway wharves, anchorage areas with land and water areas on national inland waterways and local inland waterways; ports, inland waterway wharves, anchorage areas in seaport waters assigned by the Ministry of Transport.

The Port Authority under the Department of Transport or the agency or unit assigned by the provincial People's Committee to perform in the locality where there is no organization of Inland Waterway Port Authority under the Department of Transport shall perform specialized state management functions at ports, inland waterway wharves (except for cross-river passenger wharves), anchorage areas that have been announced and licensed to operate on local inland waterways, specialized inland waterways connecting to local inland waterways; ports, inland waterway wharves, anchorage areas in seaport waters within the administrative boundaries of the locality assigned by the Ministry of Transport; ports, inland waterway wharves, anchorage areas as prescribed are assigned by the Minister of Transport as prescribed.

In addition, Decree No. 54/2022/ND-CP also abolishes Clause 2, Article 11 of Decree No. 78/2016/ND-CP. Accordingly, when submitting an application for a Certificate of eligibility to provide training services for crew members and inland waterway vehicle drivers, business establishments providing training services for crew members and inland waterway vehicle drivers are not required to submit a certified copy (or a copy with the original for comparison) of the Decision on Establishment or Certificate of Business Registration or Certificate of Investment Registration or other equivalent documents of the training establishment.

The above regulation takes effect from November 1, 2022.
