What plan should a business that wants to do ecotourism on agricultural land make?
The enterprise has been allocated land by the State for agricultural production but now wants to combine it with eco-tourism services on the same land. How should the enterprise develop a plan to use the land for commercial and service purposes to get approval? This is a matter of concern for Pham Thai Son (Con Cuong commune, Nghe An province).
Reply:Pursuant to Clause 3, Article 99, Decree 102/2024/ND-CP, the content of the land use plan for commercial and service purposes includes:
1. Information on land users;
2. Information about the land plot or land area currently used for the main purpose, including:
- Location, area, purpose of use, form of land use (The State allocates land without collecting land use fees; The State allocates land with collecting land use fees; The State allocates or leases land exempted from land use fees and land rent; The State leases land with one-time land rent collection for the entire lease term; The State leases land with annual land rent collection; land obtained through legal land use rights transfer from other organizations and individuals).
- Land use term (long-term term, remaining land use term in case of limited land use term);

3. Information on the area of land used in combination (location, area, purpose, time of combined use);
4. Construction and renovation plan for cases of land use for combined purposes with construction works, including new construction works and renovation of existing works;
5. Plan to dismantle the construction and restore it to meet the conditions for using the land for its main purpose when the term of use for the combined purpose expires;
6. Commitments and measures according to relevant laws to ensure that national defense and security are not affected;
- Limit the impact on the conservation of natural ecosystems, biodiversity, and environmental landscapes;
- Does not affect the land use of adjacent plots;
7. Diagrams and maps related to the land plot and land area used for combined purposes.
Preparing and submitting a detailed plan is not only a mandatory requirement according to legal regulations, but also helps businesses be proactive in their investment plans, avoiding legal risks when exploiting agricultural land in combination with service business.
