Nguyen Luong Bang Street in Vinh City was 'rectified', breaking the planning?

In the petition titled “Petition to rescue Nguyen Luong Bang Street”, the people informed: Nguyen Luong Bang Street was approved by the competent authority to be 15m wide. Of which, the roadway is 7.5m wide; the sidewalk on each side is 3.75m wide. Previously, the construction of Nguyen Luong Bang Street was carried out with the people's contributions and the support of the State. Although traffic was ensured, it did not meet standards, there was no drainage system, and no sidewalk. Therefore, the State's investment in upgrading according to the approved plan is a very good thing, and the people agreed and supported it.

Recently, when the Vinh City People's Committee approved the construction design, assigning the People's Committee of Quan Bau Ward to be the investor (expected to start construction in the period from May to June 2019), it caused concerns. That is, the determination of the road centerline had shortcomings, the alignment was shifted to the East, leading to the disruption of the original planning. There were sections on the East side of the road after being aligned, the sidewalk was only 1.4m wide. Meanwhile, on the West side of the road, after determining the road centerline, the sidewalk had a section up to 6.05m wide, but only determined to be 1.66m, the rest for personal use.
People reported that for a long time, some households have encroached on land on the west side of the road; at the same time, there are some businesses and organizations whose land area is located on the planned road. So is there an impact to realign Nguyen Luong Bang Street to the east so that households, individuals and organizations using land on the west side of the road do not have to clear the land?
Currently, the road is still in normal use. If it is to be rebuilt, it must meet standards and be in accordance with the planning. If it does not meet the requirements, it should not be rebuilt to avoid wasting state money, disrupting planning, making the city look bad, and affecting people's trust...

Nguyen Luong Bang Street in Quan Bau Ward has a starting point connecting to Phan Boi Chau Street, and an ending point connecting to Nguyen Canh Hoan Street. These are all major roads in Vinh City. Therefore, if invested and built according to the planning that people informed, it will become one of the most beautiful roads in Quan Bau Ward.
Regarding the current situation, Nguyen Luong Bang Street has been paved but is narrow in width; in addition, due to the lack of sidewalks and the condition of houses, fences of households and construction works of organizations that do not follow the planning, it is very messy, does not ensure traffic safety and loses urban beauty.
Discussing these issues, the representative of Quan Bau ward government said that the planning of Nguyen Luong Bang street was approved by the competent authority a long time ago. Specifically, in 2001, the road planning was already included in the digital map; in 2007, the approved detailed planning of Quan Bau ward also showed that Nguyen Luong Bang street had a 15m wide red line.
Recently, Vinh City People's Committee has allowed investment in the construction of Nguyen Luong Bang Street, assigning Quan Bau Ward People's Committee as the investor. The economic and technical report has been approved with a total implementation cost of nearly 7 billion VND.

Regarding the petition of the people, the representative of Quan Bau ward discussed that upon receiving the information, they had checked the reality and concluded that the consulting unit had set the centerline of Nguyen Luong Bang street according to the current status, which was contrary to the planning. Therefore, it led to the problems as the people mentioned in the petition.
After determining the cause, the ward organized a meeting with the people to clearly inform them; at the same time, it requested the consulting unit to re-determine the road centerline. Up to now, the road centerline has been re-determined; and the people on both the East and West sides of Nguyen Luong Bang Street have highly agreed, pledging to dismantle the constructions and fences that encroach on the planning, and return the land.

Residents on the east side of Nguyen Luong Bang Street, Block 2, Quan Bau Ward confirmed that the Ward People's Committee had organized an inspection after receiving a petition; had organized a people's meeting; and the consulting unit had closed the road centerline in accordance with the planning.
However, they still expressed concerns because on this route there are some agencies and units with fences and factories located on the planned road. People discussed: "The ward sees the mistake and corrects it, the people agree. But Nguyen Luong Bang Street also has organizations using land within the planned area. What about these organizations? The State has invested funds to upgrade the road, so not only households clearing the land but also organizations must comply. Only then will Nguyen Luong Bang Street ensure standards and achieve urban aesthetics...".

According to research, in the West of Nguyen Luong Bang Street, there are currently two organizations using land within the road planning area, including the Center for Clean Water and Rural Environmental Sanitation (a unit under the Department of Agriculture and Rural Development) and a company specializing in the field of agricultural and food production and trading. These two organizations have a large area of land in use within the road planning area, and have built a road fence with a length of hundreds of meters. With such a reality, if the land is not cleared, the construction of Nguyen Luong Bang Street (with a total length of nearly 600m) will be very unreasonable.
Discussing this content, Chairman of Quan Bau Ward People's Committee, Mr. Ho Sy Dung also expressed his concern. He said that the ward is planning to work with 2 units to learn about land use and announce the investment in building Nguyen Luong Bang Street.
“We will report this issue to the city. But regarding the land that the organization is using, with the authority of the ward, it is very difficult to clear the land…”.

The concern of the Chairman of the People's Committee of Quan Bau Ward is completely understandable. However, with the responsibility as the investor, the People's Committee of Quan Bau Ward should have a plan to check the current land use status not only of individual households, but also of related organizations to report to the superiors. As with the two organizations using land on the west side of Nguyen Luong Bang Street, it is necessary to study the land use, measure the land area within the planning scope, inventory the assets on the land... to report to the superiors, the People's Committee of Vinh City, to develop a plan for site clearance. Up to this point, when preparing to carry out construction, mentioning the inspection of land use of the two organizations on Nguyen Luong Bang Street is a delay, which may lead to obstacles and congestion if there is no consensus.
Quan Bau Ward has been interested in investing in infrastructure construction, not only to better serve the lives of local people but also to achieve the goal of bringing Vinh city to the standards of a civilized and clean urban area. Therefore, before construction, it is necessary to clear the land according to the planning so that upgrading and renovating the road ensures standards...
