Extension of time for procedures for private preschools in Thanh Chuong town

Regarding the incident of a kindergarten teacher kneeling in Thanh Chuong, on the afternoon of June 15, answering Nghe An Newspaper, Mr. Nguyen Huu Hien - Vice Chairman of Thanh Chuong District People's Committee said: The district's viewpoint is to handle it seriously according to the province's direction in the conclusion of the inspection team.

The district also resolutely suspended the operation of the Tuoi Tho private independent kindergarten, as it has not yet met the required operating conditions. In the coming days, if the educational institution does not comply, the district will have resolute solutions, even coercive measures, to prevent the institution from organizing illegal teaching and learning.

Mr. Nguyen Huu Hien also added: Yesterday afternoon (June 14), at the meeting between the Provincial People's Committee and Thanh Chuong District and related departments, the province also agreed to extend the time for Minh Sang Company to complete legal procedures according to regulations. The extension period does not exceed the time limit prescribed by law.

Today, the Department of Education and Training also reported on the handling of the incident at the Tuoi Tho private independent preschool. Accordingly, immediately after the incident of the clip of teachers at the Tuoi Tho private independent preschool kneeling to ask for a “suspension”, the Department requested to check and verify the information.

At the same time, the Department issued Official Dispatch No. 1162/SGDĐT-GDMN dated June 14, 2018 requesting the Thanh Chuong Department of Education and Training to advise the District People's Committee, coordinate with the Thanh Chuong Town People's Committee to take measures to propagate and persuade to soon stabilize the situation in the area; direct Thanh Chuong Town Kindergarten (public school) to receive, nurture and care for children according to the wishes of parents.

In addition, advised to convene a meeting of the Provincial People's Committee with the District People's Committee, Thanh Chuong Department of Education and Training, Thanh Chuong Town People's Committee, relevant provincial departments and branches; directly worked with Mr. Dang Minh Chuong - investor of the Tuoi Tho Private Kindergarten Project in Thanh Chuong District:

Request the investor to comply with the conclusion of the Provincial Inspectorate and the Decision of the Town People's Committee on suspending the activities of the independent preschool group at the project site until the completion of the land handover procedures from Thanh Chuong District People's Committee to the Investor to implement the project; request Mr. Dang Minh Chuong to work with the teachers of the facility, stabilize the teachers' psychology and request the teachers not to repeat impulsive behavior, negatively affecting the image of teachers in society.

The investor has complied with the decision of the Town People's Committee and the conclusions of the meeting. From June 18, 2018, no educational activities will be organized at the location where land handover procedures are being carried out to implement the Project.

On the afternoon of June 14, at the meeting of the Provincial People's Committee, 3 contents were concluded:

+ Affirm that the Tuoi Tho Private Kindergarten Investment Project in Thanh Chuong District according to Decision No. 5619/QD-UBND dated November 20, 2017 of the Provincial People's Committee on approving the investment in the Private Kindergarten Project in Thanh Chuong Town is completely correct in terms of the policy of encouraging socialized development in the field of education according to Decree 69/2008, Decree 59/2014 of the Government and Decision 13/2015 of the People's Committee of Nghe An Province; consistent with the planning of education and training development in Nghe An Province for the period 2012 - 2020 according to Resolution 70/2012 and Resolution 22/2017 of the Provincial People's Council; meeting the aspirations of the people.

However, the fact that the investor has not completed the procedures for handing over land and transferring assets on land from Thanh Chuong Vocational Training Center but has already started construction and organizing educational activities is a violation of Decree 46/2017 of the Government on the conditions for establishing and organizing activities of preschool and general education facilities, violating the Charter of preschools; it needs to be strictly handled according to the provisions of the Law;

+ The Provincial People's Committee assigns relevant departments and branches to advise the Provincial People's Committee:

i) Carry out procedures for land recovery and handover of land to the Investor to implement the Project in accordance with the 2013 Land Law and current legal documents;

ii) Evaluate assets on land for lease or resale to the Project Investor according to the provisions of Decree 69/2008 and relevant legal documents;

+ Criticize the lack of restraint, affecting the image of teachers in society and public opinion. Assign the education sector and group leaders to continue working with teachers to soon stabilize teachers' psychology, voluntarily comply with the State's decision.
