Mobilizing the entire political system to fight against illegal fishing

On the afternoon of December 1, Prime Minister Pham Minh Chinh chaired an online conference with 28 coastal provinces and centrally-run cities on combating illegal, unreported, and unregulated (IUU) fishing.

VIOLATIONS NOT COMPLETELY RESOLVED

Reporting on the results of implementing solutions to combat IUU fishing, Deputy Minister of Agriculture and Rural Development Phung Duc Tien said that on October 23, 2017, Vietnam was warned by the European Commission (EC) with a "Yellow Card" for illegal, unreported and unregulated (IUU) fishing activities.

Over the past 5 years, relevant central ministries, branches and coastal provinces and cities have organized and implemented tasks and solutions to combat IUU fishing, implemented EC recommendations, and tried to remove the "Yellow Card" warning under the direction of the Standing Secretariat, the Prime Minister and the National Steering Committee on IUU.

Up to now, the basic legal framework has been completed, meeting the requirements of combating IUU fishing. Fleet management and VMS equipment installation have had positive changes; a software system has been deployed to monitor and manage administrative violation handling activities in the fisheries sector. Overall, the implementation of control of imported aquatic products according to the provisions of the PSMA Agreement has improved compared to before.

Regular inspections, checks, propaganda and sanctions have yielded results and to date, some situations as required by the EC have been more or less remedied. So far, violations by Vietnamese fishing vessels in Pacific countries and island nations have been basically prevented and ended. In 2020, the country sanctioned over 2,000 cases with a total fine of over 61 billion VND. In 2021, there were nearly 1,700 cases with a total fine of over 21 billion VND. From the beginning of 2022 to now, there have been nearly 1,000 cases with a total fine of over 16 billion VND.

Despite some positive results, after 5 years, Vietnam has not yet had its "Yellow Card" warning lifted by the European Commission. Registration and inspection have not been completed. Fishing vessels losing connection to VMS and crossing maritime boundaries are still common, but investigation and handling of administrative violations at the local level are still very limited compared to violations. Control of fishing vessels entering and leaving ports is not strict, and the rate of monitoring output at the wharf is still low.

Along with that, the implementation of confirmation, certification and traceability of domestically exploited aquatic products still has many shortcomings; the origin of exploited aquatic products imported from abroad into Vietnam by container ships for export to markets other than Europe has not been controlled, leading to the risk of IUU violations. The situation of fishing vessels violating illegal fishing in foreign waters still occurs and is complicated...

At the conference, localities from provincial to communal levels and central ministries and branches discussed and pointed out the causes and difficulties in the fight against IUU fishing; At the same time, they proposed a number of solutions to effectively remove the IUU yellow card, combat IUU fishing, implement the EC's recommendations, and strive to remove the "Yellow Card" warning as soon as possible.

Phát biểu chỉ đạo hội nghị, Thủ tướng Chính phủ Phạm Minh Chính nhấn mạnh, mặc dù công tác chống khai thác IUU có tiến bộ, có cố gắng nhưng chưa đạt yêu cầu, trong đó có nguyên nhân là chưa đảm bảo được sinh kế lâu dài cho người dân.

Vì vậy, sau hội nghị này, Bộ Nông nghiệp và Phát triển nông thôn phối hợp với các bộ, ngành tham mưu Chính phủ ban hành Kế hoạch chi tiết các nhiệm vụ, giải pháp trọng tâm nhằm giải quyết triệt để các tồn tại, hạn chế về chống khai thác IUU theo khuyến nghị của EC. Sau khi ban hành thì tổ chức quán triệt, thực hiện nghiêm túc, quyết liệt, có kiểm tra, đánh giá cụ thể.

Nhiệm vụ thời gian tới, Thủ tướng Chính phủ cho rằng, phải nhận thức việc thực hiện nhiệm vụ chống khai thác IUU không phải là đối phó với EC mà trên hết là đảm bảo lợi ích cho người dân, cho quốc gia; nâng cao hình ảnh của đất nước, thực hiện cam kết quốc tế và là thành viên có trách nhiệm trong bảo vệ môi trường biển, bảo vệ hệ sinh thái biển.

Vì thế, cả hệ thống chính trị phải vào cuộc quyết liệt, người dân cũng phải tham gia tích cực; cần khơi dậy tính tự hào, tự trọng, đoàn kết của dân tộc, đi kèm với những giải pháp sâu rộng, hiệu quả.

Cần phải đánh giá rõ, những địa phương nào thực hiện chưa tốt thì phải tiến hành kiểm điểm, từ đó tìm ra giải pháp lãnh đạo, chỉ đạo hiệu quả hơn. Rà soát, phân loại, vận động, hỗ trợ người dân tổ chức chuyển đổi nghề phù hợp; làm việc với ngân hàng tiến hành cơ cấu nợ cho nhân dân.

Thủ tướng Phạm Minh Chính cũng đề nghị các địa phương thực hiện các biện pháp xử lý hành chính toàn diện, đầy đủ; tránh hình sự hoá các vi phạm, nhưng đối với các hành vi môi giới, móc nối, tổ chức đưa tàu cá, ngư dân Việt Nam đi khai thác bất hợp pháp ở vùng biển nước ngoài; môi giới chuộc tàu cá, ngư dân bị nước ngoài bắt giữ về nước trái phép thì phải xử lý hình sự nghiêm minh.

Bên cạnh đó, Bộ Nông nghiệp và Phát triển nông thôn, cùng các bộ, ngành, tham mưu Chính phủ sửa các văn bản quy phạm pháp luật còn vướng mắc; đồng thời chủ động rà soát, sửa đổi các quy định để thực hiện tốt công tác chống khai thác IUU. Các địa phương cũng phải phối hợp tích cực, chặt chẽ với nhau để xử lý các hành vi vi phạm trên biển.
