Prosecuted neighbor pretended to be sympathetic to rape 10 year old girl

On June 29, 2020, the People's Procuracy of Do Luong district approved the Decision to prosecute the case and prosecute the accused Tran Dinh Binh (born in 1968), residing in Hamlet 6, Lam Son commune, Do Luong district, Nghe An for the crime of Rape of a person under 16 years old. At the same time, the entire case file was transferred to the Provincial People's Procuracy for further handling according to its authority.

Accordingly, at around 9:00 a.m. one day in late April 2020, Tran Dinh Binh rode his motorbike to Cho Ban area in Lam Son commune to visit the fields. When he arrived, Binh saw NTTM (born in 2010) herding cows. Binh invited M to go with him to look for beehives. Knowing that M was lacking in affection due to her mother dying early and her father remarrying, Binh immediately pretended to care and ask about her with the purpose of easily getting close to and molesting the child.

Going to a deserted place pretending to look for a beehive but not finding one, Binh sat down and asked M to sit with him. Binh then touched M's genitals. Seeing that M did not react strongly, Binh calmly hugged and kissed the child and continued to touch her genitals.

Knowing that M often herded cows in that area in the afternoons on school holidays, Binh went in again and did the above act to her twice (but did not remember the exact date).

At around 9:00 a.m. on June 9, 2020, Binh continued to go to Cho Ban area where M. often grazed cattle. When he arrived, Binh saw T., a villager, herding cattle with M., so Binh pretended to tell M. to go find a beehive with him. This time, Binh had sexual intercourse with M.

Seeing M with Mr. Binh for a while, T. went to look for M. and saw Binh having sex with M. After having sex with M., Binh put on his pants and rode his motorbike home.

When M. came down, T. immediately asked M. about what he had just seen. M. immediately told him the whole story of how Mr. Binh forced her to have sex with him. Through the times he touched and had casual sex with M., Mr. Binh usually gave M. money ranging from 2,000 to 10,000 VND.

Upon learning of the incident, M.'s family filed a complaint against Tran Dinh Binh's vile behavior. After the investigation, the Investigation Police Agency of Do Luong District Police issued a Decision to prosecute the case, prosecute the accused and issue a Detention Order against Tran Dinh Binh for the crime of Rape of children as prescribed in Clause 2, Article 142 of the Penal Code.

Although Binh had sexually abused M. four times, her genitals were not affected and her hymen was still intact (according to the forensic examination results of the Nghe An province forensic science department).

Currently, the People's Procuracy of Do Luong district is transferring the entire case file to the People's Procuracy of Nghe An province for handling according to its authority.
