Driver was compensated more than 30 million VND by traffic police for wrongful fine
The People's Court of Ho Chi Minh City has just successfully organized a dialogue on a lawsuit against an administrative decision between the plaintiff, Mr. Le Dac Manh, and the defendant, the Head of the Road and Railway Traffic Police Department (Ho Chi Minh City Police).
Accordingly, the head of the Road and Railway Traffic Police Department (Ho Chi Minh City Police) compensated the driver more than 30 million VND for wrongly fining him.

The incident began on January 22, 2018, when Mr. Manh was driving a truck at the Hang Xanh overpass (Binh Thanh district) when a traffic police officer signaled him to stop because he thought his truck was overloaded.
The traffic police asked him to show his vehicle registration and driver’s license, but Mr. Manh refused because he believed he was not at fault. After that, the traffic police officer called three other traffic police officers to come and investigate.
Because Mr. Manh still refused to show his documents, the traffic police wrote a report for not following the traffic police's instructions. Mr. Manh's truck was taken to be weighed.
However, the results showed that Mr. Manh's load did not exceed the weight limit as previously concluded by the traffic police. The truck was later returned to Mr. Manh but the vehicle registration was confiscated.
Five days later, the traffic police decided to fine Mr. Manh more than 2.3 million VND.

Disagreeing with the above decision, Mr. Manh filed a complaint to the Ho Chi Minh City Police Department of Road and Railway Traffic. Mr. Manh's complaint was rejected by this agency.
Mr. Manh continued to send a complaint to the director of Ho Chi Minh City Police and requested compensation of more than 18 million VND for lost income when his driver's license and vehicle registration were held for 2 months.
Because the complaint was not satisfactorily resolved, in May 2019, Mr. Manh filed an administrative lawsuit, requesting compensation of 30.7 million VND. After two dialogues at the Mediation - Dialogue Center, the representative of the Head of the Road and Railway Traffic Police Department and Mr. Manh agreed on a settlement plan. Specifically, the defendant agreed to compensate the amount Mr. Manh requested. From there, Mr. Manh agreed to withdraw the lawsuit.
