What is a "talented person"?

Commenting on the content of the Law amending and supplementing a number of articles of the Law on Cadres, Civil Servants and Public Employees, Chairman of Nam Dan District People's Committee Dinh Xuan Que stated his opinion: "A current problem is that when recruiting civil servants and public employees, the regulation that full-time university degrees, part-time degrees or recruitment degrees are the same. There should be specific criteria to ensure fairness in recruiting civil servants and public employees."

Regarding the policy for talented people, Ms. Thai Thi An Chung - Deputy Head of the Legal Committee, Provincial People's Council said that the Law has not clearly defined what talent is. In reality, we currently consider talented people to be "talented", so it is proposed to add the concept of "talented people" in the Law to unify the understanding.

Mr. Nguyen Ho Canh - Legal collaborator of the Provincial National Assembly Delegation agreed with the Central Government's plan to authorize provinces and centrally-run cities to organize the attraction of talents according to local staff needs.

However, the Central Government should provide a common framework for implementation procedures to avoid mass implementation and unhealthy competition among localities.

Mr. Canh cited that in Nghe An a few years ago (nearly 100 people were targeted), after 8-10 years of working in agencies where it was unclear whether they were civil servants or public employees, many people quit their jobs and agencies because they were too old to be recruited as civil servants or public employees and did not follow the contract regime.

Contributing at the conference, Deputy Head of the Economic - Budget Committee, Provincial People's Council Dang Quang Hong suggested that the Law should include commune-level civil servants in the concept of civil servants.

Currently, the input and procedures for recruiting or selecting commune civil servants are basically the same as those for recruiting civil servants from district level and above. Therefore, there should be no distinction between commune-level civil servants.

Actual entrance exam

Delegates are concerned about the form of civil servant recruitment exams. The Law needs to regulate them scientifically to select and screen civil servants who meet the requirements of the task; it is necessary to review the recruitment and placement of students after graduation.

Exams for promotion and demotion of civil servants, and the organization of exams for promotion of civil servants are necessary, but it is necessary to pay attention to the skills to perform tasks and the job requirements of each agency and unit. Avoid the situation where small agencies have few employees but many senior specialists and experts.

Evaluation of civil servants; statute of limitations for discipline; consequences for disciplined civil servants; discipline of civil servants after retirement... should be applied in the same way as for civil servants.

Some delegates suggested that the Law should have strict regulations on procedures and time, especially the human factor, which must be suitable to the requirements of completing new duties and tasks, to avoid widespread and negative situations... in the conversion between civil servants and public employees.

The Provincial National Assembly Delegation will synthesize and report the opinions of the delegates to the National Assembly Standing Committee. It is expected that the draft Law amending and supplementing a number of articles of the Law on Cadres, Civil Servants and the Law on Public Employees will be submitted to the 14th National Assembly for consideration and comments at the upcoming 8th session.
